G-96-10-24-9B - 10/24/1996a- ORDINANCE NO. gtol0- I AN ORDINANCE AMENDING CHAPTER 10, SECTION 10.204, CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS, BY AMENDING SECTION 10.204(5) CHANGING THE TIME OF COLLECTION OF WATER AND WASTEWATER IMPACT FEES FOR COMMERCIAL AND INDUSTRIAL DEVELOPMENT; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT: I. That Chapter 10, Section 10.204(5), Code of Ordinances (1995 Edition), City of Round Rock is hereby amended to read as follows: (5) Time Impact Fees are Due The impact fees for all new construction shall be due and payable at the time a certificate of occupancy is issued. The impact fees for any new service which is not subject to permitting or inspection by the City shall be due and payable at the time the connection is made to the water and/or wastewater system. II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. Consider an ordinance changing the time of collection of water and wastewater impact fees for commercial and Industrial development. (First Reading) STAFF RESOURCE PERSON: Jim Nuse STAFF RECOMMENDATION: Traditionally, connections to the utility system do not impact the system until after a Certificate of Occupancy is issued. Staff proposes to charge Impact Fees at time of Certificate of Occupancy instead of at permit application time. This is consistent with Impact Fee collection for single family homes.
