AN ORDINANCE REPEALING PARAGRAPH V. OF ORDINANCE NO.
2476, WHICH PARAGRAPH PROVIDED FOR THE WAIVER OF
IMPACT FEES FOR COMMERCIAL AND INDUSTRIAL
DEVELOPMENT WITHIN THE CORPORATE LIMITS OF THE CITY.
WHEREAS, on June 14, 1990 the City Council adopted Ordinance
No. 2476 which provided for the adoption of water and wastewater
impact fees to off -set the costs of providing water and wastewater
service for new development; and
WHEREAS, Paragraph V. of said Ordinance No. 2476 waived said
impact fees for commercial and industrial development within the
corporate limits of the City; and
WHEREAS, the Council hereby determines that it would be in
the best interest of the City to repeal said Paragraph V. of
Ordinance No. 2476; Now Therefore
BE IT ORDAINED BY THE CITY COUNCIL OF ROUND ROCK, THAT:
I.
Paragraph V. of Ordinance No. 2476 is hereby repealed and,
unless otherwise waived by the City Council, from the effective
date hereof all commercial and industrial development shall pay the
water and wastewater impact fees provided for in Chapter 10,
Section 10.204, Code of Ordinances (1995 Edition), City of Round
Rock.

II.
A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.
B. The invalidity of any section or provision of this
ordinance shall not invalidate other sections or provisions
thereof.
Alternative 1.
By motion duly made, seconded and passed with an affirmative
vote of all the Council members present, the requirement for
reading this ordinance on two separate days was dispensed with.

STAFF RECOMMENDATION:
In order to financially prepare for future major water improvements, it is
recommended to repeal the exemption from Water and Wastewater Impact fees for
commercial and industrial development. Exemptions are still able to be made on a case
by case basis by the Council
