Q -o(.047- 3 AN ORDINANCE AMENDING CHAPTER 2 OF THE CODE OF ORDINANCES, CITY OF ROUND ROCK, TEXAS TO PROHIBIT DOGS FROM ORGANIZED SPORTING OR RECREATIONAL ACTIVITIES AT CITY -OWNED PARKS; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, a Texas home -rule municipality may adopt ordinances that are for the good government, peace, or order of the municipality; and WHEREAS, the City Council of the City of Round Rock, Texas finds that the presence of dogs at organized sporting and recreational events pose a potential hazard to the health, safety, and welfare of persons in attendance at said events; Now Therefore BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, I. That Chapter 2 of the Code of Ordinances, City of Round Rock, Texas is hereby amended by adding a section, to be numbered Section 2.500 which said section shall read as follows: SECTION 2.500 PROHIBITING DOGS AT SPORTING AND RECREATIONAL EVENTS 2.501 DEFINITIONS (1) Dog shall mean both male and female and include any, each, and every mammal of the dog family in the City of Round Rock, Texas. (2) Owner shall mean any person owning, having a right of property, keeping, being in control of, caring for, having custody of, or harboring a dog. (3) Person shall mean any individual, firm, corporation, partnership, association, trust, estate or other legal entity. (4) Organized sporting or recreational event shall mean any event which is held on a playing field or other area located at a city -owned park, and which requires the participants to C:\WPDOCS\ORDINANC\OR606130.WPD/c1b 1. (5) obtain prior approval of the Parks and Recreation Department of the City of Round Rock, Texas for the use of the city -owned park property. Playing field or area shall mean any portion of a city -owned park on which the participants in a sporting or recreational event may engage in an authorized activity, and includes, but is not limited to, any areas designated for spectators to view said event, areas where participants may rest while not engaged in said event, and any area where concession stands are situated. 2.502 OFFENSE (1) It shall be unlawful for an owner of any dog to allow said dog to be situated or remain within one --hundred (100) feet of any playing field or area at a city -owned park while an organized sporting or recreational event is in progress on said playing field or area. Evidence that the dog was restrained by a leash, chain, rope, voice command, cage, or any other means is no defense to an offense under this section. II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. READ and APPROVED on first reading this the /3t41 -day of , 1996. Consider an ordinance amending the Code of Ordinances to prohibit dogs in City parks at organized sporting events and festivals. (Second Reading) STAFF RESOURCE PERSON: Sharon Prete STAFF RECOMMENDATION: Various youth sports organizations, as well as the Chamber of Commerce, have requested the Council consider prohibiting dogs at organized events. The attached ordinance will prohibit people from bringing dogs to events such as, but not limited to, youth sports league play, tournaments and Frontier Days. This will not prohibit the City from working with a group who wants to organize an animal event (i.e., Humane Society, Kennel Club). There have been no changes since the first reading of the ordinance.
