AN ORDINANCE AMENDING CHAPTER 9, SECTION 9.1800 OF THE
CODE OF ORDINANCES, CITY OF ROUND ROCK, TEXAS TO
PROVIDE THAT SECTION 681.011 OF THE TEXAS
TRANSPORTATION CODE APPLIES TO PARKING SPACES
LOCATED ON PRIVATE PROPERTY; PROVIDING FOR A SAVINGS
CLAUSE AND REPEALING CONFLICTING ORDINANCES OR
RESOLUTIONS.
WHEREAS, a Texas home -rule municipality may adopt ordinances that are for the good
government, peace, or order of the municipality; and
WHEREAS , Section 681.009 of the Texas Transportation Code provides that a person who
owns or controls property used for parking may designate one or more parking spaces or parking areas
for the exclusive use of vehicles transporting persons with disabilities; and
WHEREAS , a municipality may provide that Section 681.011 of the Texas Transportation
Code, related to offenses for parking in spaces reserved for disabled persons, applies to parking spaces
on private property that have been designated in compliance with the identification requirements referred
to in Section 681.009(b) of the Texas Transportation Code; and
WHEREAS , Section 681.009(c) provides that a municipality may require a private property
owner or a person who controls property used for parking to conform to the standards adopted by the
commissioner of licensing and regulation under Section 5(c), Article 9102, Texas Revised Civil Statutes
Annotated, when designating parking spaces or areas for persons with disabilities; Now Therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS,
I.
That Chapter 9, Section 9.1800, Subsection 9.1807(1), of the Code of Ordinances, City of Round
Rock, Texas is hereby amended to read as follows:

9.1807 HANDICAP PARKING
(1) The city council may designate parking spaces or parking areas on property owned or
controlled by the City of Round Rock, which shall be for the exclusive use of vehicles
transporting temporarily or permanently disabled persons. A person who owns or controls
private property used for parking may designate one or more parking spaces or areas for
the exclusive use of vehicles transporting temporarily or permanently disabled persons.
Parking spaces or areas designated by the City of Round Rock or a private property
owner must be designated in compliance with and conform to the identification and
marking standards adopted by the commissioner of licensing and regulation under Section
5(c), Article 9102, Texas Revised Civil Statutes, which are codified at 16 TEX. ADMIN.
CODE Section 68.100. Section 681.011 of the Texas Transportation Code, related to
offenses for parking in spaces reserved for disabled persons, applies to parking spaces

II.
A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly
repealed.
B. The invalidity of any section or provision of this ordinance shall not invalidate other sections
or provisions thereof.

concerning handicap parking regulations. (Second Reading)
STAFF RESOURCE PERSON: Chief Buster Kuhlmann
STAFF RECOMMENDATION:
This ordinance will allow Police personnel to enforce the State handicap parking
provisions against violators parking on private property. There have been no
changes since the first reading of the ordinance. Staff recommends approval.
