G-96-04-11-12E - 4/11/1996ORDINANCE NO. 07- q& " O`'I - 11 AN ORDINANCE AMENDING CHAPTER 1, SECTION 1.2200, CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS AUTHORIZING THE COLLECTION OF A TEEN COURT FEE; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, Article 45.55 of the Texas Code of Criminal Procedure provides that a municipal court judge may defer proceedings against certain defendants who request to attend a teen court program; and WHEREAS, Article 45.55 of the Texas Code of Criminal Procedure authorizes a municipal court to require a person who requests to attend a teen court program to pay a fee set by the court, not to exceed ten dollars ($10.00), to cover the costs of administering the deferral to a teen court program; Now Therefore BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 1, Section 1.2200, of the Code of Ordinances, City of Round Rock, Texas, is hereby amended by adding a subsection, to be numbered 1.2203, which said subsection shall read as follows: 1.2203 TEEN COURT FEE The municipal court is authorized to collect a fee, not to exceed ten dollars ($10.00), from each person authorized by the municipal court judge to attend a teen court program pursuant to Article 45.55 of the Texas Code of Criminal Procedure, V.T.C.A. The fees collected by the C:\WPDOCS\ORDINANC\OR60328H.WPD/c1b municipal court hereunder shall be deposited into the city treasury for the use and benefit of the city. A person who is authorized by the municipal court judge to attend a teen court program and fails to complete the program is not entitled to a refund of the fee. II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. Consider an ordinance amending Chapter 1, Section 1.2200, Code of Ordinances to authorize the collection of a Teen Court fee ($10.00). (Second Reading) STAFF RESOURCE PERSON: Joanne Land/Tracie Glaeser STAFF RECOMMENDATION: State law allows the collection of a $10.00 fee by Municipal Court in order to help defray administrative costs connected with this program. For individuals requesting disposition of their cases by Teen Court, staff is requesting that a $10.00 fee be charged. The Municipal Judge may waive the $10.00 fee if after a hearing the Court determines that there is evidence that the teen is unable to pay. There have been no changes to the ordinance since the last reading.
