AN ORDINANCE ACKNOWLEDGING RECEIPT OF "CERTIFICATE OF
UNOPPOSED STATUS" PURSUANT TO § 2.052 TEXAS ELECTION CODE;
DECLARING UNOPPOSED CANDIDATES TO BE ELECTED TO THEIR
RESPECTIVE OFFICES AND CANCELING THE MAY 4, 1996 CITY
COUNCIL ELECTION; PROVIDING FOR A SAVINGS CLAUSE AND
REPEALING CONFLICTING ORDINANCES.
WHEREAS, pursuant to § 2.052 Texas Election Code, the City
Secretary, who is also the authority responsible for having the official
ballot for City Council elections prepared, has certified in writing that
each candidate for office in the May 4, 1996 election is unopposed, and
WHEREAS, § 2.053 Texas Election Code provides that upon
receipt of such a certificate that the Council may declare each
unopposed candidate elected to the office, Now Therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS:
I.
The Round Rock City Council hereby acknowledges receipt of a
Certificate of Unopposed Status from the City Secretary that each
candidate whose name is to appear on the ballot for the May 4, 1996
City Council election is unopposed. A copy of such Certificate is
ordered to be attached to this ordinance as an exhibit.
II.
Pursuant to § 2.053 Texas Election Code, the City Council
hereby declares that each of the following unopposed candidates are
elected to their respective offices:
a) Charlie Culpepper Mayor, City of Round Rock
b) Robert Stluka City Council, Place 1
City of Round Rock
c) Earl Palmer City Council, Place 4

III.
Pursuant to § 2.054, the City Council election previously
scheduled for May 4, 1996 is hereby canceled, and it is ordered
that a copy of this ordinance be posted on election day at each
polling place that would have been used in the election.
IV.
A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.
B. The invalidity of any section or provision of this ordinance
shall not invalidate other sections or provisions thereof.
Alternative 1.
By motion duly made, seconded and passed with an affirmative vote
of all the Council members present, the requirement for reading this
ordinance on two separate days was dispensed with.

Certificate of Unopposed Status
I, Joanne Land, City Secretary for the City of Round Rock,
Texas, and being also the authority responsible for having the
official ballot prepared for City Council elections, do hereby
certify, pursuant to § 2.052 Texas Election Code, that each
candidate whose name is to appear on the ballot for the May 4, 1996
City Council election is unopposed. The unopposed candidates and
their respective offices are as follows:
a) Charles Culpepper Mayor, City of Round Rock
b) Robert Stluka City Council, Place 1

ITEM: 12I. Consider an ordinance cancelling the May 4, 1996 City
Council election and declaring each unopposed candidate
officially elected. (First Reading)
STAFF RESOURCE PERSON: Joanne Land
STAFF RECOMMENDATION: During the last Legislative Session an amendment to
the Election Code was passed which allows cities to cancel an election if each candidate
whose name is to appear on the ballot is unopposed, there are no declared write-in
candidates and no proposition is to appear on the ballot. Round Rock complies with all
three stipulations. Attached is a "Certificate of Unopposed Status" stating that Mayor
Culpepper, Councilman, Place 1 Stluka and Councilman, Place 4 Palmer have no
opposition for their respective offices. Therefore, staff recommends that the City Council
cancel the May 4, 1996 City Officer Election and declare Charles Culpepper as Mayor,
Robert Stluka as Councilman, Place 1 and Earl Palmer as Councilman, Place 4.
FOOTNOTE: I checked with TML concerning the number of cities who have been able
to take advantage of this legislation. TML has heard from 20 cities so far who will be
cancelling their May election, They do not have a total cost savings but indicate the
savings will be "substantial." Because of a January election date, Huntsville was the first
city in the State to cancel their council election.
