CT - q5- a L) AN ORDINANCE ENACTING A MORATORIUM ON THE ISSUANCE OF BUILDING PERMITS FOR THE CONSTRUCTION OF STORAGE FACILITIES; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, a Texas home -rule municipality may adopt ordinances that are for the good government, peace, or order of the municipality; and WHEREAS, a Texas home -rule municipality may adopt ordinances to protect the health, safety, and welfare of its citizens and the community; and WHEREAS, Chapter 211 of the Texas Local Government Code, V.T.C.A. authorizes a Texas home -rule municipality to divide the city into zoning districts to regulate the permitted uses within the districts; and WHEREAS, pursuant to Chapter 211 of the Texas Local Government Code, a Texas home -rule municipality may amend the zoning regulations applicable in the municipality; WHEREAS, the City of Round Rock, Texas, is considering amendments to the Round Rock Zoning Ordinance related to the permissible zoning districts for mini -storage facilities; and WHEREAS, the City Council of the City of Round Rock, Texas desires to adopt this ordinance in order to ensure that the development of additional mini -storage facilities do not conflict with the amended zoning regulations and the City of Round Rock's land use objectives; NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT : I. The issuance of building permits for the development, erection, and construction of mini -storage facilities, mini - warehouses, self -storage facilities, and similar uses and/or structures within the city limits of Round Rock, Texas is hereby suspended until May 1, 1996. Every officer, employee, or agent of C:\WPDOCS\ORDINANC\OR51214D.WPD/c1b the City of Round Rock is hereby prohibited from issuing any building permit(s) for the development, erection, or construction of said types of storage facilities. Unless extended by the passage of an additional ordinance, this ordinance shall cease to be effective on May 1, 1996. If, before May 1, 1996, the Round Rock Zoning Ordinance is amended with respect to the permissible zoning districts for mini -storage facilities, mini -warehouses, self - storage facilities, and similar uses and/or structures, this ordinance shall cease to be effective on the effective date of any such amendments to the Round Rock Zoning Ordinance. II. The provisions of this ordinance shall not prohibit the City of Round Rock, Texas from enacting additional ordinances extending the moratorium on the issuance of building permits for storage facilities beyond the moratorium period established by this ordinance. III. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. Alternative 1. (First Reading) STAFF RESOURCE PERSON: Joe Vining STAFF RECOMMENDATION: Approval This moratorium is a temporary measure the City is taking to allow time for staff to consider location and design criteria options. The moratorium will be lifted once this information is available and the necessary code amendments have been made. ECONOMIC IMPACT: None.
