AN
ORDINANCE VACATING A PORTION OF A 10 FOOT WIDE
PUBLIC UTILITY EASEMENT LOCATED WITHIN LOT 1 OF
"RESUBDIVISION OF LOT 3, CORRIDOR PARK I" IN ROUND
ROCK, TEXAS; PROVIDING A SAVINGS CLAUSE AND REPEALING
CONFLICTING ORDINANCES AND RESOLUTIONS.
WHEREAS, Security Capital Industrial Trust, as the owner of
Lot 1 of "Resubdivision of Lot 3, Corridor Park I", has through its
representative, Stanley Thomas, petitioned the CITY COUNCIL OF
ROUND ROCK, TEXAS, requesting the City to vacate a portion of a 10
foot wide public utility easement contained witnin said Lot; and
WHEREAS, all authorized public utility users of said easement
have concurred in writing with said petition; Now Therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS, THAT:
I.
That the City Council hereby vacates and abandons all of that
certain public utility easement within Lot 1 of "Resubdivision of
Lot 3, Corridor Park I", a subdivision recorded in Volume 94, Page
169, of the Plat Records of Travis County; said public utility
easement being more particularly described by metes and bounds on
Exhibit "A" attached hereto.
II.
A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.
B. The invalidity of any section or provision of this
ordinance shall not invalidate other sections or provisions
thereof.

That Williamson Properties, Incorporated, a private corporation, of
the County of Williamson. State of Texas, hereinafter referred to as Grantors,
Nether one or more, for and in consideration of the sum of Ten Dollars
(110.00) and other good and valuable consideration, to Grantors in hand paid
by the City of Round Rock, Texas, the receipt and sufficiency of which is
,hereby acknowledged and confessed. and for which no lien, express or implied
ie retained, have this day GRANTED and CONVEYED. and by these presents do
grant and convey unto the City of Round Rock, a municipal corporation situated
in the County of Williamson, an easement for the construction and maintenance
of public utilities in, upon and across the following described property, to -wit;
A11 that certain tract, piece or parcel of land, lying and being situated
in the County of Williamson, State of Texas described in EXHIBIT "A", "B",
"C" i "D" attached hereto and made a part hereof for all purposes, to
which reference is here made for a more particular description of said
property.
TO HAVE AND TO HOLD the same perpetually to the City of Round Rock, and
its successors and assigns, together with the right and privilege at any and
all times to enter said premises, or any part thereof, for the purpose of
constructing and maintaining said public utility lines, and for making con-
nections therewith; all upon the condition that the City of Round Rock will
at all times after doing any work in connection with the construction or
repair of said public utility lines restore the surface of said premises to
the condition in which the same was found before such work was undertaken.

TEXAS, BEING ALL OF SAID EASEMENT LOCATED WITHIN LOT 1
OF "RESUBDIVISION OF LOT 3 CORRIDOR PARK I", A
SUBDIVISION ACCORDING TO THE PLAT THEREOF RECORDED IN
PLAT VOLUME 94 PAGE 169 AND 170 OF THE PLAT RECORDS OF
TRAVIS COUNTY, TEXAS, SAID EASEMENT BEING MORE
PARTICULARLY DESCRIBED BY CENTERLINE AS FOLLOWS:
BEGINNING FOR REFERENCE on a iron rod found on an angle point in
the northerly right-of-way line of Parker Drive (80.00 -foot right-of-way width
at this point), said point being also the most westerly corner of said Lot 1,
same being a point in a 90.00 -foot -wide tract of land conveyed to the City of

Corridor Park I", a subdivision according to the plat thereof recorded

TRAVIS COUNTY, TEXAS
WHEREAS, Investex Financial Limited Liability Co., Owner of 21.256 acres, of
land out of the A. Spreecher No. 101 & William Bratton Survey, Abstract No.
103, situated in the City of Round Rock, Texas, did subdivide said 21.256
acres of land known as Resubdivision of Lot 3, Corridor Park I, and, after
obtaining acceptance and approval of said Subdivision Plat by the Planning and
Zoning Commission of the City of Round Rock, Texas, did file said Plat for
record in Volume 94, Page 169, of the Plat Records of said Travis Co., Texas,
and,
WHEREAS, Security Capital Industrial Trust, gained ownership of LOT 1,

Property Records of Travis County, Texas, and,
WHEREAS, Security Capital Industrial Trust, being the owner of said Lot 1, now
desires to vacate all that portion of a 10 -foot -wide PULIC UTILITY EASEMENT ON
LOT 1, Resubdivision of Lot 3, Corridor Park I; and the approval of the City
Council of the City of Round Rock, Texas, has been obtained for the partial
vacation of said PUBLIC UTILITY EASEMENT; and the authorities of the City of
Round Rock, Texas, have not made actual appropriation of any proposed
dedication by said document by entry, use or improvement which would be
disturbed by this vacation, and such vacation is authorized by law;
NOW THEREFORE, Security Capital Industrial Trust, does by these presents
hereby declare the portion of said easement located on Lot 1, recorded in
Volume 94, Page 169, of the Plat Records of Travis County, Texas, as shown on
an attached Exhibit "A", to be vacated and cancelled;
