AN ORDINANCE AMENDING CHAPTER 4, §4.502(13) TO ADD
"TOPLESS DANCING BARS" TO THE DEFINITION OF SEXUALLY
ORIENTED BUSINESSES AND §4.504(2) TO APPLY THE MINIMUM
DISTANCE REGULATIONS TO RESTRICTED ESTABLISHMENTS
LOCATED IN THE CITY'S EXTRATERRITORIAL JURISDICTION;
PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING
ORDINANCES OR RESOLUTIONS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND
ROCK, TEXAS, THAT:
I.
That Chapter 4, §4.502, of the Code of Ordinances, City of
Round Rock, Texas, is hereby amended to read as follows:
(13) "Sexually Oriented Business" means a sex parlor,
nude studio, modeling studio, topless dancing bar,
love parlor, adult bookstore, adult movie theater,
adult video arcade, adult movie arcade, adult video
store, adult motel, or other commercial enterprise
the primary business of which is the offering of a
service or the selling, renting or exhibiting of
devices or any other items intended to provide
sexual stimulation or sexual gratification to the
customer;

That Chapter 4, §4.504(2), of the Code of Ordinances, City of
Round Rock, Texas, is hereby amended to read as follows:
(2) Before the issuance of a permit, the applicant must
certify that the proposed Sexually Oriented
Business will be located a minimum of 1,000 feet
from the following restricted establishments which
are located either within the City's
extraterritorial jurisdiction or within the City's
corporate limits:

(a) A child care facility;
(b) A church or place of religious worship;
(c) A dwelling;
(d) A public park;
(e) A school; or
(f) Another sexually oriented business.
III.
A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.
B. The invalidity of any section or provision of this
ordinance shall not invalidate other sections or provisions
thereof.
Alternative 1.
By motion duly made, seconded and passed with an affirmative
vote of all the Council members present, the requirement for
reading this ordinance on two separate days was dispensed with.

STAFF RECOMMENDATION: Adoption of the ordinance
The City's ordinance regulating sexually oriented businesses
is adopted pursuant to the Local Government Code. This amendment
merely clarifies what the staff believes is the intent of the
current ordinance, i.e. that "topless dancing bars" are within the
definition of Sexually Oriented Businesses, and that the 1,000 foot
distance requirement applies to establishments located within the
City's ETJ as well as within the corporate limits.
