G -95-03-23-9A AN ORDINANCE ADOPTED PURSUANT TO SECTION 10.204(7), CODE OF ORDINANCES (1990 EDITION), CITY OF ROUND ROCK, TEXAS WAIVING WATER AND WASTEWATER IMPACT FEES FOR PUBLIC SCHOOL BUILDINGS; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES. WHEREAS, the City of Round Rock has, in accordance with Chapter 395, Local Government Code, V.A.T.S., adopted water and wastewater impact fees to pay a portion of the cost of constructing capital improvements or facility expansions necessary to serve new development with water and wastewater service, and WHEREAS, §10.204(7) Code of Ordinances (1990 Edition) provides that the Council by ordinance may waive or reduce the impact fees for certain classes of development if there is a finding that the proposed waiver or reduction would result in substantial economic benefit to the City, NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, THAT: I. Pursuant to §10.204(7) Code of Ordinances (1990 Edition), the Council hereby determines and finds that waiving the water and wastewater impact fees for public school buildings will result in a substantial economic benefit to the City. KS/ORDINANCE 0R50323A II. The water and wastewater impact fees adopted in §10.204 Code of Ordinances (1990 Edition) are hereby waived for public school buildings. III. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. Alternative 1. By motion duly made, seconded and passed with an affirmative vote of all the Council members present, the requirement for reading this ordinance on two separate days was dispensed with.
