AN ORDINANCE CALLING AN ELECTION FOR THE EXCHANGE
OF TWO TRACTS CONTAINING APPROXIMATELY 11.0 ACRES OF
PARKLAND OWNED BY THE CITY OF ROUND ROCK, TEXAS, FOR
10.0 ACRES OF PARKLAND OWNED BY THE OLD SETTLERS
ASSOCIATION OF WILLIAMSON COUNTY, TEXAS; PROVIDING A
SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES
AND RESOLUTIONS.
WHEREAS, the City Council of Round Rock, Texas deems it
advisable to call the election hereinafter ordered, Now Therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS, THAT:
I.
An election shall be held on May 6, 1995, in said City, in the
regular voting precincts, at the polling places, and with the
election officers as follows:
a. Round Rock High School, 300 Lake Creek Drive, Round Rock,
Texas:
Presiding Judge: Sharon Johannsen
b. C.D. Fulkes Middle School, 300 W. Anderson, Round Rock,
Texas:
Presiding Judge: Connie Evers
c. Brushy Creek Elementary, 3800 Stonebridge, Round Rock,
Texas:
Presiding Judge: Rita Fitch
II.
The Presiding Judges shall appoint not less than two qualified
election clerks to serve and assist in conducting said election;

provided that if the Presiding Judge actually serves as expected,
the Alternate Presiding Judge shall be one of such clerks.
III.
At said election the following proposition shall be submitted
in accordance with law:
PROPOSITION NO. 1
Shall the City Council of Round Rock be authorized to exchange
two tracts of land containing approximately 11.0 acres of parkland
as described in Exhibit "A" attached hereto for 10.0 acres of
parkland owned by the Old Settlers Association of Williamson
County, Texas as described in Exhibit "B" attached hereto.
IV.
The official ballots for said election shall be prepared in
accordance with the Texas Election Code so as to permit the
electors to vote "FOR" or "AGAINST" the aforesaid Proposition, with
the ballots to contain such provisions, markings, and language as
required by law, and with such Proposition to be expressed
substantially as follows:

FOR THE EXCHANGE OF TWO TRACTS CONTAINING APPROXIMATELY 11.0
ACRES OF PARKLAND OWNED BY THE CITY OF ROUND ROCK FOR
AGAINST 10.0 ACRES OF PARKLAND OWNED BY THE OLD SETTLERS
ASSOCIATION OF WILLIAMSON COUNTY, TEXAS, ALL THREE TRACTS
LOCATED APPROXIMATELY THREE MILES EAST OF IH -35, ROUND
ROCK, WILLIAMSON COUNTY, TEXAS.
V.
A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.
2.
B. The invalidity of any section or provision of this
ordinance shall not invalidate other sections or provisions
thereof.
Alternative 1.
By motion duly made, seconded and passed with an affirmative
vote of all the Council members present, the requirement for
reading this ordinance on two separate days was dispensed with.

FIELDNOTE DESCRIPTION
BEING a 9.258 acre tract of land out of the Prior A. Holder Survey,
Abstract No. 297 situated in Williamson County, Texas and being a portion
of that certain 71.110 acre tract conveyed to the City of Round Rock,
Texas by Special Warranty Deed recorded in volume 1760, page 475 of
the Official Records of Williamson County, Texas, said 9.258 acres
being more particularly described by metes and bounds as follows:
BEGINNING at a 3/8 inch iron rod found at the intersection of barbed
wire fences ( North, East and South ), said corner being situated South
00° 39' 51" East, a distance of 1,718.19 feet from a 1/2 inch iron
rod found marking the northwest corner of aforesaid 71.110 acre tract;
THENCE North 00° 39' 51" West, along the general line of said barbed
wire fenceline, a distance of 637.53 feet to a 1/2 inch iron rod Set
for the northwest corner of this tract;
THENCE departing the west line of said 71.110 acre tract and through
said tract, North 89° 20' 09" East (perpendicular to the previous course
), a distance of 538.98 feet to a 1/2 inch iron rod Setfor an angle
point in the northeast line of this tract;
THENCE South 42° 09' 40" East, a distance of 143.44 feet to a point
for corner approximately 30 foot offset from the centerline of a 24
foot wide asphalt roadway ( "Park Road" );
THENCE along the said 30 foot offset to the centerline of "Park Road"
the following six (6) courses:
Along a non -tangent circular curve to the left having a radius
of 490.98 feet, through a central angle of 21° 13' 04", an arc
length of 181.82 feet, a chord bearing South 37° 13' 48" West,
a chord distance of 180.78 feet to a point for the end of said
curve;
South 31°04'05"West, a distance of 155.23 feet to a point of
curvature of a non -tangent circular curve to the left having a
radius of 276.46 feet;
along said curve to the left, through a central angle of 46° 23'
30", an arc length of 223.85 feet, a chord bearing South 13° 05'
03" West, a chord distance of 217.78 feet to point for the end
of said curve;
South 08° 34' 09" East, a distance of 61.06 feet to a point of
curvature of a non -tangent circular curve to the right having

THENCE departing "Park Road", and along the north line of said 30.000
acre tract, South 88° 35' 01" West, a distance of 355.31 feet to a
1/2 inch iron rod set (0.7' west of existing fenceline) in the aforesaid
west line of 71.110 acre tract, for the southwest corner of this tract;
THENCE along the west line of said 71.110 acre tract, North 01° 24'

I FIELD NOTES FOR 10.000 ACRES
FIELD NOTES describing a 10.000 acre tract or parcel of land, in the
Willis Donaho, Jr. Survey, Abstract No. 173, situated in Williamson
County, Texas, being a portion of that certain 425.540 acre TRACT I, as
described in deeds to The City of Round Rock, Texas, recorded in Volume
1300, Page 489 of the Deed Records of Williamson County, Texas, and to
The Old Settlers Association of Williamson County, Texas, recorded in
Volume 1300, Page 492 of said Deed Records, and being more particularly
described by metes and bounds as follows:
BEGINNING at an iron pin found on the south right-of-way line of County
Road No. 113, being an easterly corner of that certain 75.875 acre
tract of land conveyed to J.: Meier, by deed recorded in Volume 908,
Page 700 of said Deed Records, also being the most northerly northwest
corner of said 425.540 acre TRACT I, for the northwest corner and POINT
OF BEGINNING of the hereinafter described tract;
THENCE along the south right-of-way line County Road No. 113, for the
north line hereof, the following three (3) courses:
1.) S74°38'56"E, 115.23 feet to an iron pin found for an angle point
hereof;

SUBJECT: City Council Meeting, March 9, 1995
ITEM: 9.B. Consider an ordinance calling a special election to exchange parkland
between the City of Round Rock and the Old Settlers Association. (First
Reading)
STAFF RESOURCE PERSON: Joanne Land/Sharon Prete
STAFF RECOMMENDATION:
The City of Round Rock and the Old Settlers Association have agreed to exchange
certain property located in Old Settlers Park at Palm Valley. The exchange includes 1) 10+
acres presently referred to as the YMCA property would become City property; 2) 2+ acres
that the Palm House sets on would go to the Old Settlers Association; and 3) 9+ acres north
of the creek and west of Harrell Parkway would also go to the Old Settlers Association.
Staff is in favor of the exchange because it will allow the City to construct more youth
sports field adjacent to the existing facilities and accommodate development of the pioneer
vllage.
According to State law, in order to accomplish this goal, an election must be held on
one of the State's four uniform election dates. The next uniform election date is May 6,
1995.
The revised field notes have not been received. Keith Hickman is aware that they
must be delivered to City Hall by 12:00 noon, March 8, 1995 or this item will be withdrawn.
