G-94-12-22-9C - 12/22/1994ORDINANCE NO. g ' qq - 0-902- 6)�AN ORDINANCE AMENDING CHAPTER 1, CODE OF ORDINANCES (1990 EDITION), CITY OF ROUND ROCK, TEXAS, BY ADDING SECTION 1.2800; BY PROVIDING FOR A REWARD FOR INFORMATION LEADING TO THE ARREST AND PROSECUTION OF INDIVIDUALS FOR COMMITTING CRIMINAL MISCHIEF WITHIN THE CITY LIMITS OF THE CITY OF ROUND ROCK; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS.. WHEREAS, a Texas home -rule municipality may adopt ordinances that are for the good of government, peace, or order of the municipality; and WHEREAS, a Texas home -rule municipality may adopt ordinances to protect the health, safety, and welfare of its citizens and the community; and WHEREAS, acts of criminal mischief, including acts of vandalism and/or applying graffiti to tangible property are damaging to the public and private property situated within the City of Round Rock; and WHEREAS, such damage to public and private property encourages urban and neighborhood blight; and WHEREAS, the existence of urban and neighborhood blight has a detrimental effect on the community as a whole; and WHEREAS, the continuing commission of such criminal mischief requires a significant amount of law enforcement resources to be expended in locating and apprehending the individuals responsible for such acts; and KS/ORDINANCE OR41222C WHEREAS, the City of Round Rock desires to encourage individuals with knowledge of such acts to provide that information to the law enforcement authorities; and WHEREAS, such knowledge will enable law enforcement authorities to more efficiently apprehend the individuals responsible for such criminal mischief; and WHEREAS, the increased ability of law enforcement authorities to apprehend individuals responsible for acts of criminal mischief will deter others from engaging in such illegal activity, will enhance the peace and order of the City, and will increase the City's protection of the health, safety, and welfare of the community; Now Therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 1, Code of Ordinances (1990 Edition), City of Round Rock, Texas, is hereby amended by adding a section, to be numbered Section 1.2800, which said section shall read as follows: SECTION 1.2800: REWARD FOR CRIMINAL MISCHIEF INFORMATION The City of Round Rock hereby offers a standing reward in an amount up to $200.00 to the person or persons who furnish information leading to the arrest and prosecution of any individual for committing the crime of Criminal Mischief, as provided for in Section 28.03 of the Texas Penal Code, as hereafter amended, within the city limits of the City of Round Rock. This reward is a standing offer, and shall be paid out of the general fund of the City of Round Rock, Texas. The Chief of Police of the City of Round Rock shall determine the amount of the reward, if any, to be paid to the person or persons furnishing the information. This offer for a reward shall not apply to any officer, employee, or agent of the City of Round Rock, or any other officer, employee, or agent of the State of Texas or political subdivision thereof, who provides information or makes an arrest in the discharge of official duties. 2. The Chief of Police of the City of Round Rock is the sole judge of any dispute arising over the reward and the person or persons, if any, entitled to share in it, and his decision on any point connected with the reward will be final and conclusive. II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof.
