G-94-02-10-8H - 2/10/1994ORDINANCE NO. 0 " q 14 - OcA - ) 0 - C9)11 AN ORDINANCE WAIVING CERTAIN REQUIREMENTS OF SECTION 3.110, CODE OF ORDINANCES (1990 EDITION), CITY OF ROUND ROCK, FOR THE ISSUANCE OF BUILDING PERMITS FOR RESIDENTIAL CONSTRUCTION OF FOUR (4) UNITS OR LESS; PROVIDING A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS. WHEREAS, certain older areas of the City of Round Rock, as well as formerly rural areas that have been subsequently annexed, are not in compliance with the subdivision laws of the State of Texas and the City, and WHEREAS, Section 3.110, Code of Ordinances (1990 Edition) , requires that a building permit shall not be issued until all subdivision requirements are met, unless specifically waived by ordinance adopted by the City Council, and WHEREAS, the Council finds and determines that it is in the best interests of the City to waive the requirement that the subdivision laws be complied with before a building permit may be issued in those areas of the City depicted on Exhibits A, B, C, D, and E, which are attached hereto and incorporated herein, Now Therefore BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT: I. Pursuant to the terms of Section 3.110, Code of Ordinances (1990 Edition), the requirement for compliance with state and city subdivision regulations prior to the issuance of a building permit for residential construction of four (4) units or less is hereby KS\ORDINANCE OR02104H waived for the areas of the City which are depicted on Exhibits A, B, C, D, and E, which are attached hereto and incorporated herein, subject to the following conditions: a) The owner of any tract for which a building permit is sought shall execute an acknowledgement that the tract has not been legally platted, b) If applicable, the owner of any tract for which a building permit is sought shall execute an acknowledgement that the tract does not front on a public street which is maintained by the City, and c) If applicable, the owner of any tract for which a building permit is sought shall execute an acknowledgement that the tract is not served with City water and wastewater service, and that such service will not be provided until the tract is legally platted. II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. Alternative 1.
