G-94-02-10-8D - 2/10/1994ORDINANCE NO. 0 - AN ORDINANCE GRANTING RESIDENTIAL WATER SERVICE TO CUSTOMERS LOCATED OUTSIDE THE CITY LIMITS OF ROUND ROCK, TEXAS; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, the property known as the "Forsman Tract" is located outside of the corporate limits of the City of Round Rock, and WHEREAS, the only water well located on the Forsman Tract has failed, and WHEREAS, there is adequate capacity of water service to serve one residential connection on the Forsman Tract without impairing services within the City, and WHEREAS, the owners of the Forsman Tract have agreed to bear the costs of extending water lines to the Forsman Tract and the residence located thereon, and WHEREAS, all design and construction shall be in accordance with City standards and specifications, and WHEREAS, the rates for the water service shall be in accordance with § 10.201(5)(b), Code of Ordinances (1990 Edition), Now Therefore BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT: I. Except as set forth below, the Council hereby finds and determines that all of the requirements of § 10.103, Code of KS/ORDINANCE OR02104D Ordinances (1990 Edition), regarding the furnishing of water service outside the city limits have been complied with, and water service shall be provided to the Forsman Tract for one residential connection. II. Because of the emergency nature of this request, the Council finds and determines that the requirement of § 10.103(f) that water will not be provided to residential users who utilize septic tanks is hereby waived. The rates charged for the water service shall be in compliance with § 10.201(5)(b), Code of Ordinances (1990 Edition), City of Round Rock, Texas. Iv. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. Alternative 1. By motion duly made, seconded and passed with an affirmative vote of all the Council members present, the requirement for reading this ordinance on two separate days was dispensed with. KALLMAN Engineers and Environmental Consultants January 14, 1994 Mr. James Nuse Director of Public Works City of Round Rock 221 East Main Street Round Rock, Texas 78664 RE: REQUEST FOR TEMPORARY RESIDENTIAL WATER SERVICE FOR PAUL FORSMAN'S HOUSE Dear Mr. Nuse: On behalf of Mr. Paul Forsman, I would like to request permission to serve water to Mr. Paul Forsman's house through a connection to an existing 12" water line at the west end of Logan Drive in Southcreek Subdivision (see attached drawing.) Mr. Forsman's existing well has failed and he would like to be served by the City of Round Rock water system. A temporary connection via a single residential water meter can be made at the end of Logan. From that point, a private line can be installed across Mr. Forsman's field to his existing house. Since the 150 -acre Forsman Tract is currently being planned for residential development, this temporary connection would remain in service until such time as the Forsman Tract is developed. We are requesting this service be approved on an annual basis, as the development of the Forsman Tract is monitored. The property is being considered for development. This service will be provided as per ordinance if the Council desires. Please see attached request.
