G-93-09-23-9E - 9/23/1993ORDINANCE NO. g 3- 09-3 - 9E AN ORDINANCE AMENDING THE RATE CHARGED FOR WATER SERVICE TO THE BRUSHY CREEK MUNICIPAL UTILITY DISTRICT; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR A SAVINGS CLAUSE; REPEALING CONFLICTING ORDINANCES. WHEREAS, the Brushy Creek Municipal Utility District ("BCMUD") and the City of Round Rock ("City") entered into that certain Agreement Between The City of Round Rock and Williamson County Municipal Utility District No. 2 For the Sale of Potable Water ("Agreement") on October 14, 1986, and WHEREAS, on July 20, 1990, City filed a petition with the Texas Water Commission (TWC) seeking TWC review of the water rates provided for in the Agreement, and WHEREAS, after an evidentiary hearing, the TWC issued on June 2, 1992 an order providing for revised water rates and a revised methodology for determining just and reasonable rates, and WHEREAS, the excess demand which BCMUD has placed on the City's water system has increased significantly during the current fiscal year, and WHEREAS, the City Council wishes to adopt a revised water rate for BCMUD utilizing the latest cost of service factors, the latest peak use date and the TWC approved methodology, and WHEREAS, the City Council has determined that the rate adopted below is just and reasonable as required by the Texas Water Code, Now Therefore KS/ORDINANCE OR0909F2 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 10, Section 10.201(7), Code of Ordinances (1990 Edition), City of Round Rock, Texas is hereby amended to read as follows: (7) Rates for Water Service To Brushy Creek Municipal Utility District (a) The rate for water service to Brushy Creek Municipal Utility District ("BCMUD") shall consist of a Volumetric Rate and a Monthly Excess Capacity Charge, both of which are due and payable on a monthly basis. (b) The Volumetric Rate for water is $0.93 per 1,000 gallons of water delivered. (c) The Monthly Excess Capacity Charge shall be determined by multiplying the Monthly Excess Capacity Rate by BCMUD's Excess Capacity. The Monthly Excess Capacity Rate is $15,117 per million gallons per day (MGD) of Excess Capacity. The Excess Capacity shall be equal to BCMUD's peak day usage expressed in MGD less BCMUD's annual average day usage. II. The rate adopted herein shall become effective on October 1, 1993 and the volumetric rate shall be applied to water delivered thereafter. The monthly excess capacity charge adopted herein shall be charged for October, 1993 and for each month thereafter. III. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. 2. READ and APPROVED on first reading this the , 1993. Consider an ordinance adopting a water rate for Brushy Creek Municipal Utility District. (Second Reading) STAFF RESOURCE PERSON: Bob Bennett STAFF RECOMMENDATION: Please see the attached information on this matter. The proposed rate includes consumption over the summer thus reflecting a new peak. The volume charge should be $1.02 per 1,000 gallons and an excess capacity charge of $16,125 per month per mgd of excess capacity. Applying this excess capacity charge to Brushy Creek Municipal Utility District's current estimated excess capacity factor indicates a monthly charge of $37,996 assuming they have reached their peak and the purchase for September is 50,000.000 gallons.
