AN ORDINANCE SETTING A DATE AND TIME FOR A PUBLIC
HEARING TO BE HELD IN THE CITY COUNCIL CHAMBERS TO
DETERMINE WHETHER OR NOT CONDITIONS EXIST WHICH
RENDER CERTAIN BUILDINGS OR STRUCTURES UNSAFE UNDER
THE PROVISIONS OF SECTION 1.3 UNSAFE BUILDING
ABATEMENT CODE, CHAPTER 3, CODE OF ORDINANCE (1990
EDITION), CITY OF ROUND ROCK, TEXAS, AUTHORIZING AND
DIRECTING THE CITY SECRETARY TO PUBLISH NOTICE OF SUCH
PUBLIC HEARINGS.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS, THAT:
I.
On the 14th day of October, 1993, at 7:00 o'clock p.m. in the
City Council Chambers, City of Round Rock, Texas, the City Council
will hold a Public Hearing giving all interested persons the right
to appear and be heard on the proposed repair or demolition by the
City of Round Rock, Texas, of the property described in Exhibit "A"
attached hereto and made a part hereof.
II.
On the 28th day of October, 1993, at 7:00 o'clock p.m. in the
City Council Chambers of the City of Round Rock, Texas, the City
Council will hold a public hearing giving all interested persons
the right to appear and be heard on the proposed repair or
demolition by the City of the above described property.
III.
The City Secretary is hereby authorized and directed to cause
notices of such Public Hearings to be published in a newspaper
having general circulation in the City, such notices to be

published at least once in such newspaper not less than fifteen
(15) days prior to said hearings, all in accordance with Section
1.3, Unsafe Building Abatement Code, Chapter 3, Code of Ordinances
(1990 Edition), City of Round Rock, Texas.
IV.
A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.
B. The invalidity of any section or provision of this
ordinance shall not invalidate other sections or provisions
thereof.
Alternative 1.
By motion duly made, seconded and passed with an affirmative
vote of all the Council members present, the requirement for
reading this ordinance on two separate days was dispensed with.

ITEM: SG. Consider an ordinance setting the date, time and place of
a public hearing to consider the demolition of certain
properties. (First Reading)

STAFF RECOMMENDATION:
The following buildings are being considered for demolition:
202 E. Austin Ave.
1309 Ledbetter St.
902 Bowman Rd.
900 Clark St.
702 S. Mandell St.
7 Chisholm Trial Rd.
Behind 109 Moye St.
14 Chisholm Trail Rd.
16 Chisholm Trail Rd.
203 E. Liberty Ave.
The process is:
1. Unsafe property identified.
2. Inspection made by Building Official or Code Enforcement Officer and property
determined to be either safe or. unsafe.
3. If property determined to be unsafe a letter is sent by certified mail to owner giving them
30 days to get either demolition permit or building permit to rehabilitate structure.
4. If no action is taken by owner, Building Official requests City Council to hold a public
hearing to determine if building is unsafe.
5. City Council by ordinance will set a date and time for a public hearing for proposed
repair or demolition of properties.
6. Notification of public hearing will be sent to owner by certified mail at least 15 days
prior to date of hearing. Public hearing will also be published in legal notice section of
newspaper at least 15 days prior to hearing dates.
7. At public hearing City Council will determine if building is safe or unsafe.
8. If found to be unsafe building will he ordered repaired or demolished. Owner will have
15 days to appeal through court system.
9. If not appealed, repaired, or demolished by owner City will take competitive bids for
demolition and charge owner, if not paid a lien will be filed on property.
