G-93-08-26-12B - 8/26/1993G"' ORDINANCE NO. - l 3 - 0 8- GD - l c2 Q AN ORDINANCE AMENDING THE GENERAL PLAN OF THE CITY OF ROUND ROCK, TEXAS, ADOPTED IN SECTION 11.201(2), CODE OF ORDINANCES (1990 EDITION), CITY OF ROUND ROCK, TEXAS, TO ALLOW A COMBINATION OF COMMERCIAL AND MULTI- FAMILY LAND USES IN AN AREA CURRENTLY DESIGNATED AS COMMERCIAL IN SAID GENERAL PLAN; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, an application has been made to the City Council of Round Rock, Texas to rezone 29.39 acres of land located in the Wiley Harris Survey, Abstract 289 (1000 South Mays Street) more further described in Exhibit "A", from District C-1 (General Commercial) to District Planned Unit Development (PUD), and WHEREAS, said District Planned Unit Development will include a combination of commercial and multi -family land uses, and WHEREAS, the Planning and Zoning Commission held a public hearing concerning the requested change on the 19th day of August, 1993, following lawful publication of the notice of said public hearing, and WHEREAS, after considering the public testimony received at such hearing, the Planning and Zoning Commission has recommended that the zoning classification of the above-described property be changed from District C-1 (General Commercial) to District Planned Unit Development (PUD), and WHEREAS, on the 26th day of August, 1993, after proper notification, the City Council held a public hearing on the requested change, and KS/ORDINANCE OR08263B WHEREAS, the City Council has determined that substantial changes in conditions have occured which justify the zoning classification change provided for herein, and WHEREAS, each and every requirement set forth in Chapter 211, Subchapter A, Texas Local Government Code, and Section 11.305(2), Code of Ordinances (1990 Edition), City of Round Rock, Texas, concerning public notices, hearings and other procedural matters has been fully complied with, NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That the General Plan adopted in Section 11.201(2), Code of Ordinances (1990 Edition), City of Round Rock, Texas, is hereby amended to allow a combination of commercial and multi -family land use on the property described in Exhibit designated as commercial use. (First Reading) STAFF RESOURCE PERSON: Joe Vining STAFF RECOMMENDATION: Approval PLANNING AND ZONING COMMISSION: Approval On August 19, 1993 the Planning and Zoning Commission recommended approval of the request to amend the 1990 General Plan. (Reference PUD agreement under Agenda Item 12.C.) ECONOMIC IMPACT: Amending the General Plan to allow mixed land uses in an area previously designated as Commercial will permit the development of much needed apartment housing.
