G-93-06-10-8G - 6/10/1993ORDINANCE NO. a- 9,3-0(0_ /0- AN 0 AN ORDINANCE AMENDING CHAPTER 6, SECTION 6.615(1)(c), CHAPTER 10, SECTIONS 10.201(5)(d) AND 10.202(1)(d), CODE OF ORDINANCES (1990 EDITION), CITY OF ROUND ROCK, TEXAS BY DISCONTINUING DISCOUNTED GARBAGE, WATER AND WASTEWATER RATES FOR RESIDENTS AGE 65 AND OLDER AFTER THE EFFECTIVE DATE OF THIS ORDINANCE; ALLOWING RESIDENTS AGE 65 AND OLDER RECEIVING DISCOUNTED, GARBAGE, WATER AND SEWER RATES PRIOR TO THE EFFECTIVE DATE OF THIS ORDINANCE TO CONTINUE TO RECEIVE SAID DISCOUNTED RATES; DISALLOWING THE UNLAWFUL ACCEPTANCE OF DISCOUNTS; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT: I. That Chapter 6, Section 6.615(1)(c), Code of Ordinances (1990) Edition, City of Round Rock, Texas is hereby amended to read as follows: (c) Except as provide below, on and after June 10, 1993, the garbage rate discount for head of household residents 65 years of age and older will be discontinued. All head of household residents 65 years of age and older actually receiving said discounts prior to June 10, 1993 shall continue to receive said discounts as stated in this section, so long as they re- apply for said discounts before October 30 of each year. For residential service located within the corporate limits where the head of household has attained the age of sixty-five (65) , and if said resident head of household was receiving garbage rate discounts prior to June 10, 1993, and if said resident head of household re -applies for said discount between October 1 an October 30 of each year, said head of household shall be entitled to a $1.00 per month discount from the residential sanitation charge. In order to be entitled to said discount, the head of house shall make a sworn application therefor and present proof of age. It shall be a violation of this Code for anyone to make a false statement on such application, or to receive such discount without being eligible therefore. Each month a discount is unlawfully received shall be considered a separate violation. KSIORDINANC/OR06103X II. That Chapter 10, Section 10.201(5)(d), Code of Ordinances (1990) Edition, City of Round Rock, Texas is hereby amended to read as follows: (d) Age 65 and Older (1) Discounts Discontinued after June 10, 1993. Except as provided below, on and after June 10, 1993 the water rate discount for head of household residents 65 years of age and older will be discontinued. All head of household residents 65 years of age and older actually receiving said discounts prior to June 10, 1993 shall continue to receive said discounts as stated in this section, so long as they re -apply for said discounts before October 30 of each year. (ii) Discounts for Current Recipients. For residential service located within the corporate city limits where the head of the household has attained the age of sixty-five (65), and if said resident head of household was receiving water rate discounts prior to June 10, 1993, and if said resident head of household re- applies for said discounts between October 1 and October 30 of each year, then the following schedule of monthly rates or charges for services furnished by the city's water system shall be and such is hereby adopted and established as follows: Rate Number of Gallons of Water Used 1 - 20,000 gallons 20,000 gallons to 75,000 gallons Use exceeding 75,000 gallons Monthly Charge Monthly Water Rates $1.20 per 1,000 gallons $1.45 per 1,000 gallons used exceeding 20,000 gallons up to 75,000 gallons $1.70 per 1,000 used exceeding 75,000 gallons Except as provided below, in addition to the foregoing rates, each user shall also pay a monthly water service charge of $5.50 regardless of the amount of water used. 2. Medicaid Exemption In the event that the head of a household provides proof that he/she is eligible for Medicaid benefits as determined by Federal guidelines and as administered by the State of Texas, said household shall be exempt from paying the monthly water service charge. Eligibility for this exemption will be determined at the time of application and on April 1 and October 1 of each year. Heads of households receiving the exemption shall immediately notify the city in the event they become ineligible to receive Medicaid benefits. This exemption shall not apply to users located outside the corporate limits of the city. It shall be unlawful for anyone to receive this exemption who is not eligible thereto. (iii) Unlawful acceptance of discount. It shall be unlawful for anyone to apply for and/or receive a water rate discount if person is not eligible to receive said discount. III. That Chapter 10, Section 10.202(1)(d), Code of Ordinances (1990) Edition, City of Round Rock, Texas is hereby amended to read as follows: (d) Age 65 and Older (i) Discounts Discontinued after June 10, 1993. Except as provided below, on and after June 10, 1993 the wastewater rate discount for head of household residents 65 years of age and older will be discontinued. All head of household residents 65 years of age and older actually receiving said discounts prior to June 10, 1993 shall continue to receive said discounts as stated in this section, so long as they re -apply for said discounts before October 30 of each year. (ii) Discounts for Current Recipients For residential service located within the corporate city limits where the head of the household has attained the age of sixty-five (65), and if said resident head of household was receiving wastewater rate discounts prior to June 10, 1993, and if said resident head of household re -applies for said discounts between October 1, and October 30 of each year, then the following schedule of monthly rates or charges for services furnished by the city's water system shall be and such is hereby adopted and established as follows: 3. Rate $1.20 per 1,000 gallons of water used for all users. Monthly Charge Except as provided below, in addition to the foregoing rates, each user shall also pay a monthly sewer service charge of $5.50 regardless of the amount of water used. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. Alternative 1. (First Reading) STAFF RESOURCE PERSON: David Kautz STAFF RECOMMENDATION: The Advisory Board for the Aging has recommended that the Council discontinue providing discounts for Water, Wastewater and Garbage rates for senior citizens as of a date to be set by the Council. Staff concurs with the recommendation of the Advisory Board.
