G-93-05-27-9A - 5/27/1993ORDINANCE NO. -q 3- 05- - g fl AN ORDINANCE AMENDING CHAPTER 10, SECTION 10.204, CODE OF ORDINANCES (1990 EDITION), CITY OF ROUND ROCK, TEXAS, BY AMENDING SECTION 10.204(2) TO RE -DEFINE LIVING UNIT EQUIVALENTS RELATIVE TO WASTEWATER PRODUCTION; BY ADDING A NEW SECTION 10.204(9) ADOPTING A CAPITAL IMPROVEMENT PLAN, LAND USE ASSUMPTIONS AND IMPACT FEES; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, Sec. 395.052, Tex. Local Gov't Code, requires a municipality imposing impact fees to update its Impact Fee Land Use Assumptions and Impact Fee Capital Improvements Plan at least every three (3) years (dating from the day the initial Impact Fee Capital Improvements Plan is adopted); and WHEREAS, the City Council desires to adopt its updated Impact Fee Land Use Assumptions and Capital Improvements Plan in order to comply with said Texas Local Government Code requirements for same; Now Therefore BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT: That Edition), (2) I. Chapter 10, Section 10.204(2), Code of Ordinances (1990 City of Round Rock is hereby amended to read as follows: Living Unit Equivalent Defined For the purposes of this subsection a living unit equivalent (LUE) consumes 450 gallons per day of water and produces 350 gallons per day of wastewater. That Chapter 10, Section 10.204, Code of Ordinances (1990 Edition), City of Round Rock is hereby amended by adding a new Section 10.204(9), which shall read as follows: (9) Updated Capital Improvement Plan and Land Use Assumptions. That pursuant to Section 395.052, Texas Local Government Code, the City must adopt new Land Use Assumptions and Capital Improvement Plans at least every three (3) years from the day the initial Impact Fee Capital Improvement Plan was adopted. The Capital Improvement Plan and Land Use Assumptions dated May 6, 1993, on record in the office of the City Secretary are hereby adopted and incorporated by reference. That the remaining portions of Chapter 10, Section 10.204, Code of Ordinances (1990 Edition), City of Round Rock are hereby readopted and shall remain in force and effect as written. IV. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. Alternative 1. These overall densities are as follows: The northeast quadrant will be assigned an overall residential density of six dwelling units per gross developable acre. The southeast quadrant will be assigned an overall density of six dwelling units per gross developable acre west of the MKT right-of-way and five dwelling units per gross developable acre east of the MKT right-of-way. The northwest quadrant will be assigned a density of four dwelling units per gross developable are. The southwest quadrant will be assigned a density of four dwelling units per gross developable acre. The application of these residential density assignments will result in the following number of new residential dwelling units for each of the quadrants: Northwest 16,568 Units Southwest 424 Units Southeast 14,307 Units Northeast 37,914 Units The population and land use projections are for the total "build out" of Round Rock and its entire ETJ. This covers a projected time period of 60 years. The description of the general nature of the capital improvements includes the following: A. Water supply, treatment, and distribution facilities. B. Wastewater collection and treatment facilities. C. Drainage and flood control facilities. D. Roadway facilities. The CIP for (A) and (B) are being developed at this time. The service area will be determined as part of the development of the Capital Improvement Plan. 2lncludes right-of-way. Page 2 Capital Improvements Advisory Committee May 5, 1993 CONTRACTS OUTSIDE THE ETJ Chapter 395.001(c) of the Local Government Code provides for the following: "A municipality may contract to provide capital improvements, except roadway facilities, to an area outside its corporate boundaries and extraterritorial jurisdiction and may charge an impact fee under the contract, but if an impact fee is charged in that area, the municipality must comply with this chapter." The City of Round Rock has contracts with two municipal utility districts which lie partially outside the Round Rock ETJ. These are the Williamson County MUD No. 2 and the Fern Bluff MUD. The Williamson County MUD No. 2 contains 2,210 acres, of which 465 are within the Round Rock ETJ. This leaves 1,715 acres to be served by contract outside of the Round Rock ETJ. The Fern Bluff MUD contains 695 acres, of which 6 lie within the Round Rock ETJ. This leaves 689 acres to be served by contract outside the Round Rock ETJ. Land use assumptions for these areas will be determined primarily by the limitations of the water contracts themselves. Both contracts prohibit industrial uses. WILLIAMSON COUNTY MUD No. 2 The Williamson County MUD No. 2 water contract provides for 6,200 living unit equivalents (LUE). The portion of these LUE for the 1,715 acres of the MUD which lie outside of the Round Rock ETJ equals 5,100 LUE. While the MUD contract does not identify or reference specific acres for the permitted residential, commercial, and institutional land uses, it does effectively state the number of LUE permitted and the formula for calculating LUE for various non -industrial land uses. Since the LUE will be the common definitive unit used to provide an equivalency or conversion table establishing the ratio of a service unit to various types of land uses, this number of total LUE will be used to determine total demand generated by the combined land uses permitted in this MUD. FERN BLUFF MUD The Fern Bluff MUD water contract restricts development to that outlined in the Preliminary Engineering Report dated June, 1985. These include 2,934 residential units and 28 acres of commercial development. There are no industrial uses. This report provides for a total of 2,970 LUE. The 6 acres of this MUD which lie within the Round Rock ETJ will become part of Arterial 2 and will not generate any demand for water or wastewater services. Therefore, the total of 2,970 LUE is attributable to development outside of the Round Rock ETJ. OTHER CONTRACTS In addition, various contracts provide for the provisions of water to specific sites outside of the ETJ to service existing development. These do not provide for servicing future development and are therefore not considered in these Land Use Assumptions. Page 3 Capital Improvements Advisory Committee May 5, 1993 Therefore, it is recommended that the foregoing land uses, as outlined in the Round Rock General Plan 1990, together with the LUE calculations for portion of the Williamson County MUD No. 2 and Fern Bluff MUD which lie outside of the Round Rock ETJ, be adopted as the "LAND USE ASSUMPTIONS RELATING TO POSSIBLE ADOPTION OF IMPACT FEES" as required by Chapter 395 of the Local Government Code of the State of Texas. These land use assumptions will be the subject of a public hearing on May 20, 1993, and will be available for review by the public in the offices of the Planning and Community Development Department of the City of Round Rock, Texas, commencing Friday, May 7, 1993. Wastewater Treatment Plant Capacity: 350 gallons per day per LUE X 2.40 per gallon per day of capacity = $840./LUE. Note 1: Williamson County MUD No. 2 and Fern Bluff MUD are not Round Rock wastewater customers. Note 2: Texas Water Commission rules allow only 90% of the wastewater plant capacity to be utilized prior to additional wastewater plant capacity being provided. 2. Wastewater Collection Capacity: The Brushy Creek WCID #1 of Williamson and Milam Counties (District) has established a wastewater collection system fee of $944 per LUE for all customers of that district. Since the City of Round Rock is a customer of the district, a payment by Round Rock of $944 per LUE is required for each customer that the City connects to the District's collection system. This LUE fee is comprised of $99.50 per LUE for "common" costs due to the oversizing of certain components of the existing Wastewater Treatment Plant and $844.50 (round to $845.00) per LUE for "Wastewater Collection System" costs. Therefore, the impact fee for wastewater collection is $845.00 per LUE. (Note: Preliminary capital cost for "common" oversizing costs and for the Brushy Creek Regional Wastewater Collection System costs were developed in a September 1988 "Brushy Creek Regional Wastewater System Facility Plan" prepared by Camp, Dresser and McKee, Inc., Consulting Engineers. The LUE fee of $944 was then determined by the Brushy Creek WCID No. 1 of Williamson and Milam Counties based on a build -out of the proposed system in that facility plan.)
