G-93-04-22-8A - 4/22/1993ORDINANCE NO. t1 - 93- 04- - 8A AN ORDINANCE ESTABLISHING AN ECONOMIC DEVELOPMENT PROGRAM TO PROMOTE LOCAL ECONOMIC DEVELOPMENT AND TO STIMULATE BUSINESS AND COMMERCIAL ACTIVITY IN THE CITY OF ROUND ROCK; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, 5380.001 Local Government Code provides that the governing body of a municipality may establish and provide for the administration of one or more programs, including programs for making loans and grants of public money to promote local economic development and to stimulate business and commercial activity in the municipality, and WHEREAS, Investex Financial Limited Liability Company ("Investex") has purchased Lot 1 of Corridor Park I, a subdivision in Travis County, Texas ("Property") for the purpose of locating a food processing facility, and WHEREAS, Corridor Place is a cul-de-sac which is located adjacent to the Property on three sides, shown more fully in Exhibit A attached hereto, said cul-de-sac hereinafter referred to as "Corridor Right -of -Way", and WHEREAS, the Corridor Right -of -Way is not necessary to provide access to the proposed food processing facility, and WHEREAS, the conveyance of the Corridor Right -of -Way to Investex would be beneficial to the operation of the food processing facility, and OR04223A WHEREAS, the Corridor Right -of -Way has been appraised for the sum of Forty -Two Thousand Dollars ($42,000.00), and WHEREAS, the City Council has determined that the grant and conveyance of the Corridor Right -of -Way to Investex qualifies as a program under the authority of §380.001 Local Government Code, Now Therefore BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT: I. This Ordinance is adopted pursuant to the authority of §380.001 Local Government Code. II. That City Council finds that the recitals set forth above are true and that the grant and conveyance of the Corridor Right -of -Way to Investex is a program that will promote local economic development and stimulate business and commercial activity in the City of Round Rock. III. Subject to the agreement of Investex to construct a food processing facility on the Property, the Mayor is hereby authorized to execute a special warranty deed conveying the Corridor Right -of - Way to Investex. The deed shall contain a provision that the conveyance will revert to the City in the event the food processing facility is not completed. IV. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. 2. B. The invalidity of any section or provision ,of this ordinance shall not invalidate other sections or provisions thereof. Alternative 1.
