O-92-2591 - 9/24/1992ORDINANCE NO. o J I AN ORDINANCE AMENDING CHAPTER 1, SECTION 1.1902, CODE OF ORDINANCES (1990 EDITION); REVISING THE LIBRARY USER FEE PROVISION; REVISING THE FEES FOR FAILURE TO RETURN LIBRARY MATERIALS BY THE DUE DATE; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 1, Section 1.1902(2) shall be amended to read as follows: (2) Library User Fee (a) No library user fee for the issuance of a library card shall be charged to a resident of the city or to a non-resident who owns real property within the city according to the records maintained by the city tax office, provided that the non-resident also has no delinquent property taxes due at the time the card is issued. (b) No library user fee for the issuance of a library card shall be charged to a non-resident full time employee of the City of Round Rock. (c) All other non-residents shall be charged an annual non-refundable fee of fifteen dollars ($15.00) per person or twenty-five dollars ($25.00) per family for the issuance of a library card. (d) The City Manager or his designee shall have the authority to waive the library user fees for persons with economic hardships. II. That Chapter 1, Section 1.1902(3) shall be amended to read as follows: OR09102I (3) Late Return Fees Fees shall be paid by the borrower for failure to return, at the date due, any books or other library materials and equipment which have been loaned to holders of library cards. The fee is hereby set at ten cents ($0.10) per day per book. The maximum fee for E and ER level books shall be five dollars ($5.00). The maximum fee for all other level books, other printed material, and cassette tapes shall be eight dollars ($8.00). A grace period of one (1) week shall be allowed, and no fees charged if the books are returned within said grace period. III. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. READ and APPROVED on first reading this the ' C Lk' day of 3 , 1992. (Second Reading) STAFF RESOURCE PERSON: Dale Ricklefs STAFF RECOMMENDATION: It is recommended that the maximum library fine for children's books be increased from $2.00 to $5.00 and all others be increased from $5.00 to $8.00. These amounts will be similar to the fines charged by the City of Austin. The cost to process overdue notices and verify holdings is similar in both cities. It is estimated that increased revenues will run about 30% above what they are currently with this higher rate, as well as push a few into the litigation area (a minimum of $50.00 in fines and unreturned books results in a notice from the attorney and possible litigation). It is also recommended to allow non-resident staff members free use of the public library. The public library should have as its mission the service to the general taxpaying citizen as well as to serve as a library for city staff and Council needs. This ties into the continuous education philosophy of total quality management, and references in our TQM manual to books in the library on total quality management. Free use will not extend to family members. It is estimated, based on prior requests, that 10-20 non-resident employees will use the library. Several of these employees are on the first 10 grades of the city's pay scale. Finally, it is recommended that wording be placed in the ordinance allowing the City Manager or his designate to waive non-resident fees. When the non-resident fee was first instituted, the Council felt concern for those incapable of paying for a card, and gave the Library Director verbal approval to waive the card fee. However, this was not placed in the ordinance. It is recommend that wording to this effect be placed in the ordinance.
