The Home Rule -,Charter Commission met May 31, 1977 - at 7 : 30
P.M. .in the Library Meeting Room.
ROLL CALL: Present: Richard-A. Wells , Robert Rhoades , Harriet
. Rutland,, Dianne Blanchard, Joy Johnson, Edward LeClair, Anthony Mays ,
Frank. Norris , Robert L. Peters , Jr. , Don Quick, Walter Tibbitts, and
N.-. . G. Whitlow.. Absent: Larry Jackson, Jean Loving and Gordon Perez.
APPROVAL OF MINUTES: Minutes from the April 25, 1977 and May -
16, 1977 meetings were approved as submitted.
GENERAL PROVISIONS: The Commission went through each section,
as presented by the General Provisions Committee,. one by one.
Bob Rhoades moved to . approve Section 3. 07 FORM OF BALLOTS as
submitted. Harriet Rutland seconded. Motion carried.
N. G. Whitlow moved to approve Section 3 . 08 RESULTS OF ELECTION
(a) INITIATIVE subject to. the removal of the last six (6) .words .
Rutland seconded. Motion carried.
Blanchard moved to change Section 3. 08 RESULTS OF ELECTION
(b) Referendum.. to .(c) rather than (b) . Peters seconded. Motion carried.
Jo" Johnson moved -.to adopt " (b)" as amended. Ed, LeClair
seconded. Motion carried. " (b)" reads as -fallows : " (b) REPEAL OR
AMENDMENT OF AN 'INITIATED ORDINANCE . An ordinance adopted by initiative
be repealed by .referendum may be renacted by two (2) years by a vote
of 5 or more of the Council members qualified and serving. "
Rutland moved to adopt the following changes under Section
3. 08:
(d) ADOPTION OF. AN ORDINANCE REPEALED BY REFERENDUM. A re-
ferred ordinance which is rejected by a majority of the legal votes cast
in a referendum election shall be deemed thereupon repealed.
Blanchard seconded. Motion carried.
Whitlow made the motion to adopt Section 3. 09 SCOPE OF RECALL.
as submitted. Blanchard seconded. Motion carried.
Rhoades moved to adopt Section 3. 10 PETITIONS FOR RECALL
as submitted. Quick seconded. Motion carried.
Dianne Blanchard moved to adopt sections 3 . 11 RECALL PROCEDURE
and Section 3. 12 FORM OF RECALL PETITION with the following changes :

(1) every place the word elector appears change to registered
voters , (2) on line 6 of section 3. 11 change them�� to the officer
or officers , " (3) on line 7 of section 3 . 11 change the word "after"
to "within", (4) on - line 7 of section 3. 11 change "24 hours" to
"2 working days" , (5) on lines 2 and 3 of section 3. 12 change
"ground or grounds" to "ground(s)" , (6) on line 6 of section 3 . 12
change "such" to "each" , (7) on line 10 of section 3. 12 change
"qualified" to "registered" and (8) on line 12 of section 3. 12
change "qualified electorate" to "registered voters of the City. "

Rutland made the motion to approve Section 3. 13 VARIOUS PAPERS
CONSTITUTING RECALL PETITION. LeClair seconded. M6tion carried.
Rutland moved to approve Section 3 . 14 PRESENTATION OF RECALL
PETITION TO CITY COUNCIL as amended below:
"The person performing the duties of City .Secretary shall
present such certified petition to the city council at the next
regular Council meeting. "
Whitlow seconded. M6tion carried.
Blanchard made the motion to approve . Section 3 . 15 PUBLIC
HEARING TO BE HELD ON RECALL PETITION as submitted. Joy Johnson
seconded. Motion carried.
Rhoades moved .to approve Section 3. 16 RECALL ELECTION TO BE
CALLED as submitted. Whitlow seconded. Motion carried.
Joy Johnson made the motion to approve Section 3. 17 BALLOTS
IN RECALL ELECTION as submitted. Peters seconded the motion. Motion
carried.
Joy Johnson made the motion to approve Section 3 . 18 RESULT
OF RECALL ELECTION subject to two changes (1) on line 8 change
"officer or officers" to "officer(s)" and (2) on line 9 change "or"
to '"nor shall. " .Norris seconded. Motion carried.
Whitlow moved to approve Section 3 . 19 RECALL, RESTRICTIONS
THEREON as submitted. Quick seconded. M6tion carried.
Quick moved to approve Section 3. 20 FAILURE OF CITY COUNCIL
TO CALL AN ELECTION as submitted. Rutland seconded. Motion carried.
• FINANCE: Next the Finance Committee went through their ,
submitted sections .
Blanchard made the motion to approve Section 8.01 FISCAL
YEAR as submitted. Peters seconded. Motion carried.

Quick moved to approve Section 8. 02 PUBLIC RECORD with one
change (1) on line' 2 change "upon request" to "for inspection upon
request". Tibbitts seconded. Motion carried.
Quick made the motion to approve Section 8 .03 ANNUAL BUDGET
with one change (1) under "B" change "September" to "August".
Rhoades seconded.. Motion carried.
Rhoades moved to approve Section 8. 04 ADMINISTRATION OF
BUDGET as submitted. Peters seconded. Motion carried.
Rhoades moved to approve Section 8 . 05 EMERGENCY APPROPRIATIONS
with one change (1) on line 6 change "not less than four" to
"five or more" . . LeClair seconded. Motion carried.
Rhoades made the motion to approve Section 8 .06 BORROWNING
TO MEET EMERGENCY APPROPRIATIONS as submitted. LeClair seconded.
Motion carried.
Rhoades made the motion to approve Section 8.07 BORROWING
• IN ANTICIPATION OF PROPERTY TAXES as submitted. Rutland seconded.
Motion carried.
Whitlow moved to approve Section 8. 08 DEPOSITORY as submitted.
Tibbitts seconded. Motion carried.
Rhoades made : the motion to approve Section 8.09 PURCHASE
PROCEDURE as submitted.' Whitlow seconded. Motion carried.
Blanchard moved .to approve Section 8. 10 INDEPENDENT AUDIT
as submitted. Whitlow seconded. Motion carried.
Rhoades moved to approve Section 9 .01 BORROWING FOR CAPITAL
IMPROVEMENTS with one change under "E-1" . On line three (3) between
the words "City" and "upon" insert "for inspection". Norris seconded.
Motion carried.
Mays made the motion to approve Sections 10 . 01 through :10 . 07
TAXATION as submitted. Rutland seconded. Motion carried.
Under Section 11. 01 BOARD OF EQUALIZATION; APPOINTMENT,
QUALIFICATIONS the first sentence should be deleted and the following
sentences be inserted:
• "The Board of Equalization shall consist of three (3) members
who shall be registered voters and real property owners in the City
of Round 'Rock, none of whom shall be employees , officers , or members
of the Council. Members of the Board of Equalization shall serve

for two (2) year terms . Two (2). members 'shall be appointed in even
numbered years and one (1) member in odd numbered years. The
appointments shall be made each at the second regular council
meeting in May of each year. For the first year after the effective
date of this Charter the Council hsall appoint all three (3) members
of the Board of Equalization and they shall draw lots to determine
who shall receive an initial one (1) year term and who shall receive
two (2) year terms . "
Quick made the motion to approve Section 11.01 with the
abovementioned change. Joy Johnson seconded. All members present
except Whitlow and Tibbitts voted yes . Motion carried.
Whitlow moved to adopt Sections 12.01 through 12 . 10 the
Franchise and Public Utility Sections with one change that being
deleting number seven (7) under 12. 04. Tibbitts seconded. Motion
carried.
Chairman Wells went over the dates for the next meetings .
