O-92-2567 - 2/27/1992ORDINANCE NO. 0562 7 AN ORDINANCE AMENDING CHAPTER 6, SECTION 6.611(4), CODE OF ORDINANCES (1990 EDITION) CITY OF ROUND ROCK, TEXAS TO INCREASE THE FEES FOR BRUSH COLLECTION; ADDING A PARAGRAPH (5) TO CHARGE THE OWNER OR OCCUPANT FOR BRUSH PICKED UP FROM RIGHT-OF-WAY; PROVIDING A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 6, Section 6.611(4), Code of Ordinances (1990 Edition) City of Round Rock, Texas is hereby amended to read as follows: (4) Brush Collection by City Upon request of the owner or occupant of a tract of land the City will remove tree trimmings and/or brush debris resulting from storm damage or created by such owner or occupant of a residence or business. The tree trimmings and/or brush debris must be placed in or adjacent to the street right-of-way. For such service, the owner or occupant will be charged a minimum of fifteen dollars ($15.00). In the event the on-site crew time exceeds five (5) minutes, an additional five dollars ($5.00) will be charged for each five (5) minute period or fraction thereof. II. That Chapter 6, Section 6.611, Code of Ordinances (1990 Edition) City of Round Rock, Texas shall be amended by adding a new paragraph (5) which shall read as follows: (5) OR02132E Brush Placed In City Right -of -Way In the event that tree trimmings and/or brush debris are placed in City right-of-way, it shall be deemed to be a request by the owner or occupant for the City to remove said trimmings and brush. The owner or occupant shall be charged for such removal in accordance with paragraph (4) above. III. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. R AD and APPROVED on first reading this the /-J day 1992. (second reading) STAFF RESOURCE PERSON: Jim Nuse STAFF RECOMMENDATION: On December 12, 1991, a presentation regarding the need to increase the brush pick-up fees. The current fee of $5.00 per 10 minutes does not nearly cover costs. This increase while not entirely cover costs but will help offset the operation loss and still allow citizens access to affordable brush collection. Staff believes this service deters "illegal" dumping in sparsely developed sub -divisions, vacant land, and city right's of way.
