AN ORDINANCE AMENDING CHAPTER 1, CODE OF ORDINANCES, 1990
EDITION, CITY OF ROUND ROCK, TEXAS BY ADDING A NEW SECTION
1.2400, WHICH PROVIDES FOR THE IMPOSITION OF A ONE PERCENT
GROSS RECEIPTS TAX ON THE CONDUCT OF BINGO GAMES WITHIN THE
CITY LIMITS OF ROUND ROCK, TEXAS AND SETTING AN EFFECTIVE DATE
FOR SAME; PROVIDING A SAVINGS CLAUSE AND REPEALING CONFLICTING
ORDINANCES AND RESOLUTIONS.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS:
I.
That Chapter 1, Code of Ordinances, 1990 Edition, City of Round
Rock, Texas is hereby amended by adding a new Section 1.2400, which
shall read as follows:
SECTION 1.2400 BINGO TAX
1.2401 IMPOSITION OF TAX
Pursuant to the Texas Bingo Enabling Act, Article 179d,
V.A.T.S., there is hereby imposed a one percent tax on all
taxable gross receipts from the conduct of bingo games held
within the city limits of Round Rock, Texas.
1.2402 EFFECTIVE DATE
The effective date of this ordinance shall be the 1st day of
March, 1992.
II.
A. All ordinances, parts of ordinances, or resolutions in conflict
herewith are expressly repealed.
B. The invalidity of any section or provision of this ordinance
shall not invalidate other sections or provisions thereof. 22

ITEM: 8B. Consider an ordinance enacting a Bingo Tax. (Second Reading)

STAFF RECOMMENDATION:
This item was discussed at the January meetings. Under current State law a
city may impose a two percent (2%) gross receipts tax on the conduct of bingo
games within the city. If a county also imposes a tax (Williamson County
does), then the city may collect only one percent (1%) of the gross receipts
and the County receives one percent (1%).
According to Bob Sauls, Attorney with the Texas Alcoholic Beverage
Commission, in order to collect our percentage of the tax, the City must pass
an ordinance imposing the tax. Since the County currently collects two
percent (2%), the amount collected will be divided between the City and the
County. The tax is born by those individuals who play bingo.
Staff recommends approval of this ordinance.
ECONOMIC IMPACT:
If the Council wishes to enact this ordinance the projected revenues will be
between $2,500 and $5,000 per year.
