Minutes - Regular Meeting - 9/6/1995 September 6, 1995 The Round Rock Charter Review Commission met on Wednesday, September 6, 1995 at 6:00 p.m. in the City Council Chamber,221 E. Main Street. ROLL CALL: Those members present were Commissioners John Manbeck,Berry Sullivan,Teke Baker, Roy Beard, Barbara Jansen, Judy McLeod, and Phil Scott. Also present were Assistant City Manager/City Secretary Joanne Land and City Attorney Steve Sheets. APPROVAL OF MINUTES: August 2. 1995 MOTION: Commissioner Baker moved to approve the minutes as submitted. Commissioner McLeod seconded the motion. VOTE: Ayes: Commissioner Baker Commissioner Beard Commissioner Jansen Commissioner McLeod Commissioner Scott Commissioner Sullivan Commissioner Manbeck Noes: None ACTION: The motion carried unanimously. CITIZENS COMMUNICATIONS: None CONSIDER DISCUSSION BY CITY STAFF AND COMMISSIONERS CONCERNING ALL ASPECTS OF THE CITY CHARTER. Bob Bennett, City Manager, said that he had no concerns or recommended changes to the existing Charter. Mayor Pro-tem Palmer informed the Commission that he had no changes to the existing Charter. Councilman Stluka said he had no concerns regarding the existing Charter. Judge McNery informed the Commission that he reviewed Section 4.03,Municipal Court, and had no concerns or recommended amendments. Joe Vining, Planning Director, provided a memo (attachment "A") concerning recommended changes to the Charter. Charter Review Commission September 6,1995 Page 2 • David Kautz recommended that Article 8, Section 8.03 (e) regarding the date the City budget should be adopted be changed to the last day of the month instead of the twenty-seventh day of the last month of the fiscal year. He added that Article 10 of the Charter has been superseded by other legislation. Commissioner Manbeck said the Commission will take the recommendations under advisement. Mayor Culpepper said he had no concerns regarding the existing Charter. Steve Sheets distributed a memo regarding his review of the new statutes. He noted that a new g g statute regarding elections could conflict with the existing Charter. He found no other statutes that would affect the Charter. In response to Commissioner McLeod's question, Sheets said the Commission would recommend to the Council that an election be held to amend the Charter. The Council would then decide if election will be held. • Commissioner Manbeck asked staff to condense the recommendations made the 1991 Charter Review Commission and staff into the existing Charter for their review prior to the next meeting. I. Section 12.02 Qualifications Revise paragraph (a) as follows: (a) Except as otherwise required by state law each candidate for appointment as a board or commission member shall meet the following requirements: (1) - (3): No change is recommended Paragraph (b): No change is recommended IL Section 12.03 Members Filing For Office No change is recommended. III. Section 12.04 Planning and Zoning Commission Revise this wording as follows: In accordance with the applicable provisions of the Texas Local Government Code there shall be a City Planning and Zoning Commission, the composition, terms of appointment, and duties and powers of which the City Council shall establish by Ordinance. Delete the following wording. "The Commission shall have the power and be required to: (1) - (7)". Notes: 1) The above deletion may necessitate amending the Planning and Zoning Commission Section of the City Code (section 11.100). 2) In its present form the City Charter contains various references to Revised Civil Statutes articles; these should now probably be made to correspond to the Local Government Code.
