O-54-203 - 10/12/1954AN ORDINANCE OF THE CITY OF ROUND ROCK,
TEXAS,DECLARING,THAT UNDER THE CONDITIONS
STATED HEREIN,THE KEEPING OF CHICKENS SHALL
CONSTITUTE A NUISANCE,AND THE ESTABLISHING OR
MAINTAINING OF SUCH NUISANCE SHALL BE PUNISHABLE
BY FINE NOT LESS THAN ONE DOLLAR NOR kORE THAN
TEN DOLLARS:AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ROUND ROCK,TEXAS:
That it shall hereafter be a nuisance to keep
any chickens at any place within this City,except that they
be kept in enclosed pen or pens;that said pen or pens
shall be at all times kept clean and sanitary in accordance
with the health and sanitary laws of the State of Texas,and
at no time shall said chickens be permitted to run outside
of such pen or pens.
That proof of any chickens are being permitted
by any person or his or her agent to run outside of
said pen or pens within said City,shall be sufficient to
make a prima facie case hereunder,unless said prima facie
case is overcome by evidence,it shall warrant a conviction„
That any person acting for himself or for another
who creates or maintains the nuisance above def my Ced
shall be guilty of a misdemeanor and upon conviction
shall be fined in any sum not less than one nor more
than ten dollars for each such offence.
That no ordinance exists adequately protecting
persons against the nuisance above definded,creates an
emergency,and that by reason thereof the rules requiring
that ordinances be read at three separate meetings before
final passage are suspended,and this ordinance is here and
now finally passed,and it is ordered that it be approved
and published at once and that it take effect from and
after passage and publication.
