R-00-01-27-13C1 - 1/27/2000RESOLUTION NO. / 00-01-J7- I3 C A RESOLUTION NOTING RECEIPT OF A PETITION TO ESTABLISH THE BEHRENS RANCH PUBLIC IMPROVEMENT DISTRICT #1, APPOINTING AN ADVISORY BODY, SETTING A DATE, TIME AND PLACE FOR PUBLIC HEARING ON ADVISABILITY OF ESTABLISHING SAID DISTRICT, AND AUTHORIZING PUBLICATION OF NOTICE. WHEREAS, BEHRENS SUBDIVISION LTD., a Texas limited partnership, L.P., have heretofore filed with the City a petition ("Exhibit 1") to request establishment of the Behrens Ranch Public Improvement District #1 ("District") under and pursuant to the provisions of Chapter 372, Local Government Code; and WHEREAS, the petition requests the establishment of the District within the corporate boundaries of the City, the boundaries of said District being described in Exhibit "A" of Exhibit "l" attached hereto and incorporated herein; and WHEREAS, the petition has stated the general nature of the proposed improvements, the estimated costs of the improvements, the boundaries of the proposed District, the proposed method of assessment, and a provision for management of the District, all of which is set forth in Exhibit "1", Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, I. The petition heretofore filed with the City by BEHRENS SUBDIVISION LTD. ("Petitioners"), a copy of which is attached hereto as Exhibit "1" and made a part hereof for all purposes, is C:\TEXT\ROUNDROC\BEHRENS\RES1.WPD/cdc hereby formally received by the City Council of the City of Round Rock, Texas. II. There is hereby created the Behrens Ranch Public Improvement District #1 Advisory Body which shall have the responsibility of developing and recommending an improvement plan to the City Council. The Advisory Body shall be composed of the following representatives of the Petitioners who are the owners or representatives of owners of all of the taxable real property within the District and the record owners of all the real property liable for assessment within the District: Chris Overstreet Chris Blackburn The following representatives of the City of Round Rock, Texas, shall also be members of the Advisory Body: Joe Vining Charles Crossfield III. The City Manager is hereby directed to use the services of municipal employees to assist the Advisory Body to prepare a report to determine whether the improvements to be considered should be made as proposed by the petition and to prepare a preliminary estimate of the costs of the improvements. RA STLC7KA, Mayor City of Round Rock, Texas Petition for Establishment of Behrens Ranch Public Improvement District #1 December 27, 1999 TO THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS AND THE MAYOR OF THE CITY OF ROUND ROCK, TEXAS: The undersigned landowners, pursuant to the Public Improvement Assessment Act, Chapter 372.001 et seq., Local Government Code, Vernon's Annot. CMI Statutes, respectfully petition the Mayor and the City Council for the establishment of the Behrens Ranch Public Improvement Assessment District #1. In Support of said petition, Petitioners would show unto the City Council the following: A. General Nature of Proposed improvements The creation of this Public Improvement District will provide for public infrastructure improvements classified into the following categories: 1. Transportation, 2. Storm Water Management and 3. Other infrastructure First, Wyoming Springs Trait is included as part of this PID in accordance with The City of Round Rock's Master Thoroughfare Plan in an attempt to connect FM 1431 and RM 620, thus relieving the North / South traffic congestion on the IH -35 corridor. At present, the Southern most section of this arterial has or will be completed as a part of community improvements near Round Rock Hospital. The Behrens Ranch PID would complete the first section of Wyoming Springs Trail / Arterial 2 in North Round Rock. Second, Central Channel Modifications are included in accordance with The City of Round Rock's Storm Water Management Plan in an effort to protect against the Toss of life and property. The Behrens Ranch Subdivision is located at the lower end of a watershed collecting runoff from 5.6 sq. miles of surrounding land. The total volume of runoff is impounded by an NRCS dam #12 (controlled by the Brushy Creek Water Control and Improvement District) located in the Southeast corner of the property adjacent to an existing residential subdivision. The proposed improvements would provide engineered modifications for the safe conveyance of large water volumes past residential properties and under roadways such as Wyoming Springs Trail. Lastly, infrastructure improvements related to a proposed Elementary School site have been included to provide for all wet and dry utilities as well as multiple access points to improved roadways. The included improvements will only be those directly related to making the site ready for construction and will be divided according to use requirements with the adjacent residential properties. B. Estimated Cost of Improvements The probable cost of improvements is $4,714,065.06 detailed in Exhibit A, and shall include the following: 1. Four Arterial lanes, constructed to City standards, from the South property line of Behrens Ranch at FM 3406 to the North property line at the Georgetown Railroad and Hy -Land Joint Venture properties. 2. A water distribution system that will service the adjacent property owners as well as provide an important link in the City's water distribution system between existing systems on FM 3406 and FM 1431. EXHtSiT /'j_ 4. A storm water system including new piping structures and channel modifications to an existing storm water management dam facility. 5. One half of all construction costs related to providing infrastructure for the proposed Elementary School site. 6. All environmental controls required by current law to provide these improvements in an ecologically sensitive manner. 7. All necessary surveying, geo-technical investigation, design, construction administration and review fees associated with the platting, construction documents and onsite construction of these improvements. 8. All professional fees associated with the purchase, financing and dedication of these improvements to the City of Round Rock. 9. All associated fees for the creation and the administration of this proposed City of Round Rock Public Improvement District. C. The Assessment District Boundary The boundaries of the proposed assessment district are described in Exhibit B attached hereto and incorporated herein. Included within Exhibit B are field notes for the entire Behrens Ranch Development as well as an overall lot layout. D. Proposed Method of Assessment The proposed method of assessment is based upon the estimated average home value of the residential lots and applying a pro rata assessment of the cost as identified in "Exhibit A" with a flat assessment on the Golf Course property. The assessment / bond proforma as prepared by First Southwest Company is attached as Exhibit C. E. Management of The District The District shall be managed solely by the City of Round Rock, Texas. F. Concurrence in Establishment of District All the undersigned request and / or concur with the establishment of the Public Improvement Assessment District. G. EXECUTED DOCUMENT FOLLOWS Petition for Establishment of Behrens Ranch Public Improvement District #1 December 27, 1999 TO THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS AND THE MAYOR OF THE CITY OF ROUND ROCK, TEXAS: The undersigned landowners, pursuant to the Public Improvement Assessment Act, Chapter 372.001 et seq., Local Government Code, Vernon's Annot. Civil Statutes, respectfully petition the Mayor and the City Council for the establishment of the Behrens Ranch Public Improvement Assessment District #1. In Support of said petition, Petitioners would show unto the City Council the following: A. General Nature of Proposed Improvements The creation of this Public Improvement District will provide for public infrastructure improvements classified into the following categories: 1. Transportation, 2. Storm Water Management and 3. Other infrastructure First, Wyoming Springs Trail is included as part of this PID in accordance with The City of Round Rock's Master Thoroughfare Plan in an attempt to connect FM 1431 and RM 620, thus relieving the North / South traffic congestion on the IH -35 corridor. At present, the Southern most section of this arterial has or will be completed as a part of community improvements near Round Rock Hospital. The Behrens Ranch PID would complete the first section of Wyoming Springs Trail / Arterial 2 in North Round Rock. Second, Central Channel Modifications are included in accordance with The City of Round Rock's Storm Water Management Plan in an effort to protect against the loss of life and property. The Behrens Ranch Subdivision is located at the lower end of a watershed collecting runoff from 5.6 sq. miles of surrounding land. The total volume of runoff is impounded by an NRCS dam #12 (controlled by the Brushy Creek Water Control and Improvement District) located in the Southeast corner of the property adjacent to an existing residential subdivision. The proposed improvements would provide engineered modifications for the safe conveyance of large water volumes past residential properties and under roadways such as Wyoming Springs Trail. Lastly, infrastructure improvements related to a proposed Elementary School site have been included to provide for all wet and dry utilities as well as multiple access points to improved roadways. The included improvements will only be those directly related to making the site ready for construction and will be divided according to use requirements with the adjacent residential properties. B. Estimated Cost of Improvements The probable cost of improvements is $4,714,065.06 detailed in Exhibit A, and shall include the following: 1. Four Arterial lanes, constructed to City standards, from the South property line of Behrens Ranch at FM 3406 to the North property line at the Georgetown Railroad and Hy -Land Joint Venture properties. 2. A water distribution system that will service the adjacent property owners as well as provide an important link in the City's water distribution system between existing systems on FM 3406 and FM 1431. JQ.- oo- -4--13/ 4. A storm water system including new piping structures and channel modifications to an existing storm water management dam facility. 5. One half of all construction costs related to providing infrastructure for the proposed Elementary School site. 6. All environmental controls required by current law to provide these improvements in an ecologically sensitive manner. 7. All necessary surveying, geo-technical investigation, design, construction administration and review fees associated with the platting, construction documents and onsite construction of these improvements. 8. All professional fees associated with the purchase, financing and dedication of these improvements to the City of Round Rock. 9. All associated fees for the creation and the administration of this proposed City of Round Rock Public Improvement District. C. The Assessment District Boundary The boundaries of the proposed assessment district are described in Exhibit B attached hereto and incorporated herein. Included within Exhibit B are field notes for the entire Behrens Ranch Development as well as an overall lot layout. D. Proposed Method of Assessment The proposed method of assessment is based upon the estimated average home value of the residential lots and applying a pro rata assessment of the cost as identified in "Exhibit A" with a flat assessment on the Golf Course property. The assessment / bond proforma as prepared by First Southwest Company is attached as Exhibit C. E. Management of The District The District shall be managed solely by the City of Round Rock, Texas. F. Concurrence in Establishment of District All the undersigned request and / or concur with the establishment of the Public Improvement Assessment District. G.
