This information is maintained on our hazmat plume modeling software and includes information that is confidential by law. We agree to provide you and your designees with the requested information through this software as an intergovernmental transfer on the condition that no portion of these records, or information derived therefrom, is disclosed to any member of the public, except as required by law. This transfer of information is not a release to the public for purposes of the Texas Public Information Act and does not violate the confidentiality of the information or waive exceptions to disclosure. In order to evidence your acknowledgement of the terms and conditions stated above, please sign below and return your signed copy to me. You will be provided access to the software upon my receipt of your signed copy of this letter agreement. Williamson County has purchased the "PEAL' software for the hazmat team, it takes all of our TIER II data, and creates worse case scenario plume models. This will allow us to do some predictive modeling either in advance or at the beginning of a hazmat event to help with the protection of the public and first responders. The software could be beneficial for us to use on emergency incidents in the City of the Round Rock. Wilco has agreed to allow us to use the software, but ask that we sign the attached document stating that we will not provide information gathered from the software to the public.
