O-89-2396 - 2/23/1989ORDINANCE NO. vL3 % AN ORDINANCE AMENDING CHAPTER 4, SECTION 6.D. CODE OF ORDINANCES, CITY OF ROUND ROCK BY ADDING PARAGRAPH (3) REGARDING PERMITTED SIGNS FOR NONRESIDENTIAL USES LOCATED WITHIN ONE HUNDRED FEET (100') OF INTERSTATE HIGHWAY 35 RIGHT-OF-WAY; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS THAT: I. Chapter 4, Section 6.D. Code of Ordinances, City of Round Rock, is hereby amended by adding a paragraph (3) which shall read as follows: (3) Nonresidential uses which are on a tract which is located no more than one hundred feet (100') of the Interstate Highway right-of-way shall each be permitted, in lieu of any other authorized signs or signs, one sign of not more than one hundred (100) square feet, provided that such sign (a) shall not be placed within any required yard, (b) shall not be placed within twenty-five feet (25') of the front property line, (c) shall not be placed within one hundred feet (100') of an existing sign permitted by this paragraph and paragraph (2) above, (d) shall not be placed more than two hundred feet (200') from the Interstate Highway 35 right-of-way and (e) shall not exceed thirty feet (30') in height. II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. Alternative 1. Consider an ordinance amending the current Sign Ordinance to provide additional signage near the Interstate Highway. (First Reading) STAFF RESOURCE PERSON: Joe Vining STAFF RECOMMENDATION: Approval. This amendment will permit larger signs, within one hundred (100') feet of IH -35. The present ordinance provides for a maximum 40 square foot sign for a single commercial development unless it abuts IH -35, in which case, the maximum size is 320 square feet. This amendment should be regarded as an interim soluation only. A comprehensive review of the sign ordinance is recommended to provide greater equity and flexibility for all developments. ECONOMIC IMPACT: None.
