AN ORDINANCE ESTABLISHING BOUNDARIES OF THE EXTRATERRITORIAL
JURISDICTION OF THE CITY OF ROUND ROCK; ACCEPTING CERTAIN
TERRITORY FROM THE EXTRATERRITORIAL JURISDICTION OF THE CITY
OF HUTTO; PROVIDING FOR SEVERABILITY; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Hutto currently exercises extraterritorial
jurisdiction over certain territory located adjacent to the
extraterritorial jurisdiction of the City of Round Rock; and
WHEREAS, the City of Hutto will consider the release of said
territory from its extraterritorial jurisdiction; and
WHEREAS, the City Council finds and is of the opinion that
implementing the acceptance of this territory into the Round Rock
extraterritorial jurisdiction will best serve the interests of both
cities as well as the public health and safety and the general
welfare of the community, NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK
PART 1. That the territory to be released by the City of Hutto
is hereby accepted into: the extraterritorial jurisdiction of the City
of Round Rock, and the extraterritorial jurisdiction of the City of
Round Rock be, and hereby is, extended to include all of that
territory which is described on the map attached hereto and
incorporated herein as Exhibit "A" as "Area to be Released by Hutto."
PART 2. That the present boundary limits of extraterritorial
jurisdiction of the City of Round Rock are hereby altered and amended
to reflect the addition of the territory described in PART 1 above to
the extraterritorial jurisdiction of the City of Round Rock.
PART 3. If any provision, section, subsection, sentence, clause
or phrase of this ordinance,
or
set of
circumstances
unconstitutional, void,
or
or the application of same to any person
is for any reason held to be
invalid, the validity of the remaining
portion of this ordinance shall not be affected thereby, it being the
intent of the City Council in adopting this ordinance that no portion
thereof or provisions, or regulations contained herein shall become
inoperative or fail by reason of any unconstitutionality of any other
portion hereof and all provisions of this ordinance are declared to
be severable for that purpose.

PART 4. That this ordinance shall become effective at 12:01 a.m.
on October 18, 1988.

of all the Council members present, the requirement for reading this
ordinance on two separate days was dispensed with.

Acceptance of the 582 acres from
ECONOMIC IMPACT: Ordinance provides for the acceptance of
582 acres (Franklin Tract) from the City of Hutto. By
including this land in our ETJ, the City of Round Rock
takes another important step toward the successful
completion of the golf course. The acceptance of the
land into the ETJ does not carry a specific economic
impact. However, the following annexation ordinance does.
