O-88-2354 - 8/25/1988ORDINANCE NO. ow --4/ AN ORDINANCE AMENDING CHAPTER 9, SECTION 10., PARAGRAPH G, CODE OF ORDINANCES, CITY OF ROUND ROCK, TEXAS, BY RESTRICTING THE USE OF BICYCLES, ROLLER SKATES, AND SKATE BOARDS ON SIDE WALKS AND PUBLIC GARAGES; PROVIDING A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 9, Section 10., Paragraph G, Code of Ordinances, City of Round Rock, Texas is hereby amended to read as follows: G. RIDING BICYCLES, ROLLER SKATES, AND SKATEBOARDS ON SIDEWALKS 1) No person shall ride a bicycle, skateboard, roller skates or other similar device upon a sidewalk within an area zoned for C-1 and C-2 (commercial use) as defined in the Code of Ordinances, City of Round Rock. 2) No person shall roller skate, ride a skateboard or bicycle in a reckless manner on any public sidewalk. No person shall ride a skateboard, roller skate or bicycle on a sidewalk without exercising due care for the safety of other persons using the sidewalk. Whenever any person is riding a bicycle, skateboard or roller skates upon a sidewalk, such person shall yield the right-of-way to any pedestrian and shall give an audible signal before overtaking and passing such pedestrian. 3) No person shall ride a bicycle, skateboard, roller skates or other similar device within city -owned parking garages within the City of Round Rock. 4) Any person, firm or corporation violating any provision of this ordinance shall be fined not less than five dollars ($5.00) nor more than two hundred dollars ($200.00) for each offense, and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues. II. A. All ordinances, parts of ordinances or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C29ORDSIDEW READ AND APPROVED on first reading this the day of , 1988. Consider an ordinance regulating skateboards. (Second Reading) STAFF RESOURCE PERSON: Joe Vining STAFF RECOMMENDATION: Approval. This ordinance will regulate the operation of skateboards in the same manner as bicycles are presently regulated. It prohibits the use of skateboards, etc. on a sidewalk in any area zoned for commercial use. (C-1 and C-2 Zones). It requires skateboard operators to yield the right of way to pedestrians and prohibits the riding of bicycles, skateboards or roller skates in any parking garage in the City. ECONOMIC IMPACT: The cost of installing new signs in the parking garage.
