O-88-2332 - 3/24/1988ORDINANCE NO. 0323,..2_,, ORDINANCE CALLING AN ELECTION AN ORDINANCE CALLING AN ELECTION FOR THE SALE, TRADE, OR LEASE OF UNUSABLE PARKLAND BELONGING TO THE CITY OF ROUND ROCK, TEXAS. WHEREAS, the City Council of Round Rock, Texas deems it advisable to call the election hereinafter ordered. THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That an election shall be held on May 7, 1988, in said City, in the regular voting precincts, at the polling places, and with the election officers as follows: a. Round Rock High School, 300 Lake Creek Drive, Round Rock, Texas: Presiding Judge: Dorman Reed b. C.D. Fulkes Middle School, 300 W. Anderson, Round Rock, Texas: Presiding Judge: Rosemary "Tish" Oatman II. That the Presiding Judges shall appoint not less than two qualified election clerks to serve and assist in conducting said election; provided that if the Presiding Judge actually serves as expected, the Alternate Presiding Judge shall be one of such clerks. III. That at said election the following proposition shall be submitted in accordance with law: PROPOSITION NO. 1 Shall the City Council of said City be authorized to sell, trade, or lease 2.416 acres of parkland, as described in Exhibit "A" attached hereto; IV. That the official ballots for said election shall be prepared in accordance with the Texas Election Code so as to permit the electors to vote "FOR" or "AGAINST" the aforesaid Propositions, with the T20ORDINANC ballots to contain such provisions, markings, and language as required by law, and with such Propositions to be expressed substantially as follows: PROPOSITION NO. 1 FOR THE SALE, TRADE, OR LEASE OF 2.416 ACRES OF UNUSABLE PARK - AGAINST LAND LOCATED ON THE SOUTH SIDE OF U.S. HIGHWAY NO. 79, AP- PROXIMATELY THREE MILES EAST OF IH -35, ROUND ROCK, WILLIAM - SON COUNTY, TEXAS. IV. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other section or provisions thereof. By motion duly made, seconded and passed with an affirmative vote of all the Council members present, the requirement for reading this ordinance on two separate days was dispensed with. Holder SL.rvey, Abstract No. 297, situated in Williamson County, Texas; said 2.416 acres being a part of the remaining portion of that certain 28.2 acre tract, known as Lot 15, of the Plat of Surveys of Swensons Part of the Holder League, as shown in Volume 13, Page 119 of said Deed Records, conveyed to Andrew J. The property is a 2.416 acre site, south of Hwy 79, which is a portion of the total Old Settlers Park at Palm Valley purchase. ECONOMIC IMPACT: This property was not included in the Park Master Plan because: - it is not a suitable park site - it is separated by Hwy 79 it is adjacent to the railroad tract - the General Plan calls for the area to be commercial/industrial The revenue generated from the sale can benefit the City.
