ORDINANCE NO. 2323 AN ORDINANCE ABANDONING A PORTION OF A CERTAIN ALLEYWAY, SAID PORTION LOCATED ON LOTS 7, 12, AND THE WEST ONE-HALF (1/2) OF LOTS 6 AND 13, BLOCK 31, TOWN OF ROUND ROCK, WILLIAMSON COUNTY, TEXAS; REPEALING CONFLICTING ORDINANCES AND PROVIDING FOR A SAVINGS CLAUSE. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That the City Council of Round Rock, Texas, after due investigation and consideration, has determined that the nature and extent of the public use and public interest warrants the vacation of part of the public alley described in this ordinance. II. That a portion of the east -and -west public alleyway lying between Round Rock Avenue and San Saba; located on lots 7, 12, and the western one-half of lots 6 and 13, Block 31, Town of Round Rock, more particularly described in Exhibit "A", said exhibit attached hereto and made a part of this ordinance, be hereby vacated and closed, inasmuch as this portion of the alley is no longer required for public use and the public interest will be served by this vacation. III. This vacation is made upon the express condition that within seven (7) days after the passage of this ordinance, the abutting landowners shall pay or cause to be paid to the City of Round Rock the sum of Four Thousand, Eight Hundred Sixty and No/Dollars ($4,860.00) as consideration for the benefits which will accrue to said landowners due to the vacation of said alleyway, said sum in the judgment of the City Council being adequate compensation. (First Reading) STAFF RESOURCE PERSON: Bob Bennett STAFF RECOMMENDATION: This alley is unused and requires no easements. The alley is immediately west of the carwash/ Ole Taco (Dairy Creme) buildings. The owner wishes to combine the alley with the two lots he presently owns. He plans to build a new ubsiness on the combined lots. ECONOMIC IMPACT: The owner has agreed to pay $3.00 per sq. ft. for the 1,620 sq. ft. alley or $4,860.
