O-87-2295 - 9/10/1987Ordinance 2295 AN ORDINANCE AMENDING ORDINANCE NO. 2290 AND CHAPTER 3, SECTION 10 CODE OF ORDINANCES, CITY OF ROUND ROCK, TEXAS, BY AMENDING LANDSCAPING REQUIREMENTS TO PROVIDE FOR AN ALTERNATIVE LANDSCAPING PLAN FOR EXCEPTIONAL CIRCUMSTANCES; TO PROVIDE A SAVINGS CLAUSE; TO REPEAL CONFLICTING ORDINANCES; AND TO PROVIDE FOR AN EFFECTIVE DATE. WHEREAS, exceptional circumstances require special landscaping solutions which may not strictly comply with ordinance requirements, and standard requirements may not always result in the most effective landscaping solution. NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND HOCK, TEXAS; THAT CHAPTER 3, SECTION 10 OF THE CODE OF ORDINANCES, CITY OF ROUND ROCK, TEXAS IS HEREBY AMENDED BY ADDING A PARAGRAPH TO SUBSECTION D, TO BE NUMBERED PARAGRAPH (9), WHICH SAID PARAGRAPH SHALL READ AS FOLLOWS: (9) In cases where a particular site opportunity exists, or where there is an unusual construction or site circumstance, an alternative landscape plan which may not strictly comply with the terms of this ordinance be submitted for approval to the Director of Planning and Community Development. ll. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. All ordinances, parts of ordinances, or resolutions in conflict hereof are expressly repealed. READ and READ, APPROVED on the first reading this the day of 1987. Allow for an alternate landscape plan, for unique circumstances, to be approved by the Director of Planning and Community Development. ECONOMIC IMPACT: 1.) No cost to the City. 2.) The allowance of an "alternate plan option" will allow for additional flexability for unique circumstances and promote community development.
