AN ORDINANCE AMENDING CHAPTER 2, CODE OF ORDINANCES, CITY OF
ROUND ROCK, TEXAS DESIGNATING VETERINARIANS TO COLLECT FEES AND
ISSUE TAGS; AND BY ADDING SECTION 4, CONCERNING WILD ANIMALS;
PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING
ORDINANCES.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS
I.
That Chapter 2, Section 3: B be amended by adding a new
subsection (5) to read as follows:
(5) That Police Chief or his designee shall authorize
licensed veterinarians within the City of Round Rock to collect
the annual license fee and issue a tag pursuant to Chapter 2,
Section 3.B of the Code of Ordinances, City of Round Rock,
Texas.
The rabies vaccination provisions shall be applicable to
cats also.
The City shall supply tags and appropriate record keeping
materials to the veterinarians in order to carry out the
requirements of this ordinance.
Veterinarians who are authorized to collect the fee shall be
entitled to retain three dollars ($3.00) of each five dollar
($5.00) fee they collect. Veterinarians designated pursuant to
this ordinance shall not be required to issue duplicate tags.
II.
That Chapter 2, Code of Ordinances, City of Round Rock, is
hereby amended by adding Section 4, Wild or Dangerous Animals.
which said section shall hereafter read as follows:
Section 4: Wild or Dangerous Animals
A. Definition
(a) Wild Animal shall mean any animal not
ordinarily tame or domesticated, or by
their very propensities toward
inflicting serious bodily harm.
(b) Dangerous Animal shall mean any dog or
other animal that, without clear
provocation, (1) bites or attacks
humans or (2) in a vicious or
terrorizing manner approaches any
person in an apparent attitude of
attack, whether or not the attack is
consummated or capable of being
consummated.
B. Wild or Dangerous Animals Prohibited
Except when being displayed pursuant to a
permit issued by the City Council of Round
Rock, it shall be unlawful for any person to
keep, maintain, use, have in his possession,
have on his premises, or under his control
any wild or dangerous animal.
(a) Wild or Dangerous Animals Displayed
Wild or dangerous animals displayed
pursuant to a permit issued by the City
Council of Round Rock must be securely
confined in a manner that said animal
absolutely cannot come into contact
with any person. The handler or
controller of the animal(s) shall be
present at any time the display is open
or accessible to the public. The
Animal Control Officer for the City of
Round Rock shall have the authority to
inspect said display, and if necessary,
request that permit be revoked for non
compliance with this Ordinance.
(b) Guard Dogs
Dogs maintained lawfully as guard dogs
or attack dogs as defined herein, shall
not be included in the definition of
"wild or dangerous animal". As used in
this section the term "guard dog or
attack dog" means any dog intended to
attack intruders that has completed
such professional training and is so
certified, or has been comparably
trained, such that its attack can be
stopped on command.
(c) Unattended Guard Dogs
It shall be unlawful for any person to
leave any guard or attack dog
unattended in any place inside any
building unless a warning sign has been
placed in a clearly visible location at
the premises, located so that it can be
seen by any person before entering the
place to which the dog has access,
warning that a guard or attack dog is
present. It shall be unlawful for any
person to leave any guard or attack dog
unattended in any place outside a
building except in a fenced yard, with
a fence adequate to prevent the dog
from leaving the premises, and with a
warning sign placed in a clearly
visible location at the premises,
located so that it can be seen by any
person before entering the place to
which the dog has access, warning that
a guard dog or attack dog is present.
Temporary Handling of a Wild or Dangerous
Animal
(a) The Animal Control Officer shall be
permitted to handle on a temporary basis a
wild or dangerous animal whenever necessary
to protect the health and welfare of the
animal itself. The Animal Control Officer
must file a written report with the Chief of
Police anytime a wild or dangerous animal is
handled showing the reason for handling, and
final disposition of the animal.
(b) A State or Federally licensed person
trained for rehabilitation centers for
injured animals shall be allowed to keep and
maintain an injured wild animal provided
that they have filed a written report with
the Animal Control Officer, said report
shall contain species, reason for handling,
and estimated date of release of the
animal. A copy of said report shall be
forwarded to the Chief of Police by the
Animal Control Officer.
D. VIOLATION OF SECTION A MISDEMEANOR
Any person acting for himself or for another
who creates or maintains the nuisance above
defined shall be guilty of a class C
misdemeanor.
A. All Ordinances, parts of Ordinances, or Resolutions in
conflict herewith are expressly repealed.
B. The invalidity of any section or provision of this
Ordinance shall not invalidate other sections or provisions
thereof.
