O-86-2222 - 3/27/1986ORDINANCE NO. 2222 AN ORDINANCE AMENDING CHAPTER 1, SECTION 33: ROAD IMPROVEMENT FEE, CODE OF ORDINANCES, CITY OF ROUND ROCK, TEXAS, TO PROVIDE THAT ROAD IMPROVEMENT FEES COLLECTED WITHIN A COUNTY ROAD DISTRICT SHALL BE USED TO RETIRE OUTSTANDING ROAD DISTRICT BONDS; PROVIDING FOR A SAVINGS CLAUSE, REPEALING CONFLICTING ORDINANCES. BE IT ORDAINED BY THE CITY COUNCIL OF ROUND ROCK, TEXAS, THAT: Chapter 1, Section 33, C., Code of Ordinances is hereby amended to read as follows: C. Road Improvement Fund (1) Except as provided in paragraph D. below, all money generated by the Road Improvement Fee shall be deposited in a separate account and used only for the purpose of the construction and improvement of the city's road and street system. II. Chapter 1, Section 33, D., Code of Ordinances is hereby added to read as follows: D. County Road and Bridge District (1) In the event that (a) property is located within the boundaries of a County Road District established pursuant to Art. 6702-1 V.A.T.S. and (b) proper agreement is reached with the County Commissioner Court, all money generated by the Road Improvement Fee for property within the Road District shall be deposited into a separate account and used for the sole purpose of paying the interest and principal of any bonds outstanding for that. Road District. A. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. B. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. READ and APPROVED on first reading this the 1134 day of 1986. Sheets Wayne Porter Kevin Henderson Re: Ordinance amending Road Improvement Fee As you may recall, when the City Council approved the creation of the Northeast Round Rock Road District there was some discussion to the effect that it was perhaps unfair for land subject to road district tax to also pay a city road improvement fee. At that time it was agreed that one solution to this inequity would be for the $200.00 road fee to be used to retire the outstanding road bonds. Now that we are rapidly approaching the actual construction of the roads, as well as the development of the property, I have drafted a proposed ordinance to accomplish what was previously discussed. I would appreciate it if you could place this ordinance on the Council's agenda for the March 13, 1986, meeting. Please let me knowif you have any questions. Stephan L.
