O-86-2246 - 8/28/1986Gattis School Road • ORDINANCE NO. 2246 AN ORDINANCE SETTING A DATE AND TIME FOR A PUBLIC HEARING TO BE HELD IN THE CITY COUNCIL CHAMBERS AND SETTING A DATE, TIME, AND PLACE FOR A PUBLIC HEARING ON THE PROPOSED ANNEXATION OF CERTAIN PROPERTY BY THE CITY OF ROUND ROCK, TEXAS, AUTHORIZING AND DIRECTING THE CITY SECRETARY TO PUBLISH NOTICE OF SUCH PUBLIC HEARINGS. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT, I. On the 9th day of October , 1986 , at 7:00 o'clock p. m. in the City Council Chambers, City of Round Rock Texas, the City Council will hold a public hearing giving all interested persons the right to appear and be heard on the proposed annexation by the City of Round Rock, Texas, of the property described in Exhibit "A" attached hereto and made a part hereof. II. On the 23rd day of October , 19 86, at 7:00 o'clock p.m. in the City Council Chambers of the City of Round Rock, Texas, the City Council will hold a public hearing giving all interested persons the right to appear and be heard on the proposed annexation by the City of the above-described property. III. The City Secretary is hereby authorized and directed to cause notices of such public hearings to be published in a newspaper having general circulation in the City and in the territory proposed to be annexed; such notices to be published at least once in such newspaper not more than twenty (20) days nor less than ten (10) days prior to said hearings, all in accordance with the Municipal Annexation Act. IV. The Director of Planning is hereby authorized and directed to prepare a service plan that provides for the extension of municipal services into the area proposed to be annexed. Sec:' 6; ''Before any city may institute annexation proceedings, the governing body of such city shall provide an- opportunity for all interested persons to be heard at two public hearings to be held not more than forty (40) days nor less than twenty (20) days prior to institution of such proceedings. At least one (1) public hearing shall be held within the area proposed to be annexed if, within ten ` (10) days after the publication of the notice required herein, more than twenty (20) adult -residents who reside in the territory proposed to be annexed protest in writing to the city secretary of the annexing city the institution of annexation _ proceedings. Each written protest shall contain the name, address, and age of'.' each protestor signing. Notice of such hearings shall be published in a newspa- per having general circulation in the ,city and in theterritory proposed to be annexed. The notice for each hearing shall be published at least once in such newspaper not more than twenty (20) days nor less than ten (10) days prior to that hearing. • Additional notice by certified mail should be given to railroad companies then serving the city and on the city's tax roll where the right-of-way thereof is included in the territory to be annexed. Annexation of territory by a city shall be brought to completion within ninety (90) days of the date on which .' the governing body of such city institutes annexation proceedings or be null and void. Provided, however, any period of time during which a city is restrained or enjoined from annexing any such territory by a court of competent jurisdiction shall not be computed in such 90 -day limitation period. C. FINAL ANNEXATION AND ORIGINAL ZONING PROCEDURES The City Council conducts the following business: 1) The City Council holds zoning public hearing on proposed annexation. 2) The City Council adopts an ordinance annexing the territory (20-40 days between public hearing and ordinance). 3) The City Council adopts ab ordinance zoning the annexed territory. DATE: August 26, 1986 SUBJECT: Council Agenda, August 28, 1986 ITEM: 11E - Consider an ordinance setting the date, time and place of a public hearing for the proposed annexation of the Gattis School Road Tract. (First Reading) Development plans are presently being considered for a large tract of land known as High Country generally located along Gattis School Road at County Road 122. It is anticipated this tract will file for voluntary annexation in the near future. To do so requires that this tract be contiguous to existing city boundaries. The extention of present city boundaries along Gattis School Road to County Road 122 would result in the High Country tract being contiguous and then eligible for voluntary annexation. In addition, important land use con- siderations along Gattis School Road would be within the City's jurisdiction and could be more consistently addressed.
