O-85-2206 - 11/26/1985ORDINANCE NO 2206 ORDINANCE TO RATIFY AND CONFIRM ORDINANCE NO. 2114 GRANTING THE CONSENT OF THE CITY OF ROUND ROCK TO THE CREATION OF THE MEADOWS AT CHANDLER CREEK MUNICIPAL UTILITY DISTRICT STATE OF TEXAS § COUNTY OF WILLIAMSON WHEREAS, the City Council of the City of Round Rock granted its consent to the creation of The Meadows at Chandler Creek Municipal Utility District by Ordinance No. 2114 dated May 10, 1984; and WHEREAS, said ordinance authorized the execution of certain agreements that were executed by the City of Round Rock pursuant to the terms of said ordinance; and WHEREAS, Exhibit "2" to said ordinance entitled "Agreement Concerning Creation of The Meadows at Chandler Creek Municipal Utility District" provided that said contract would be binding upon the City for a period of one year following the execution by the City pending creation and confirmation of the District; and WHEREAS, Exhibit "3" of said ordinance entitled "Utility Construction Contract Between the City of Round Rock, Texas, and The Meadows at Chandler Creek Municipal Utility District" contained an identical provision concerning its binding effect upon the City; and WHEREAS, said agreements were executed by the City of Round Rock on May 10, 1984; and WHEREAS, The Meadows at Chandler Creek Municipal Utility District was created by order of the Texas Water Commission on May 14, 1985; and WHEREAS, said creation was confirmed by the voters by an election on July 13, 1985; and WHEREAS, the duly elected Board of Directors of The Meadows at Chandler Creek Municipal Utility District, approved the execution of said contracts on behalf of the District at a meeting on July 16, 1985; and 2/ljd WHEREAS, both the District and the City now desire that said agreements be ratified and confirmed by the City of Round Rock such that it is clear that all parties are bound by said contract and agreements according to their terms; NOW THEREFORE, BE IT ORDAINED BY THE CITY OF ROUND ROCK, TEXAS, THAT: 1. Ordinance No. 2114, approved by the Council of the City of Round Rock, Texas, on May 10, 1984, is hereby ratified and confirmed. 2. All contracts and agreements which were executed by the Mayor on behalf of 'the City pursuant to the terms of said ordinance are hereby ratified, and the City hereby agrees that they shall be binding upon the City of Round Rock in accordance with their terms. 3. The Mayor of the City of Round Rock, Texas, is hereby authorized to again execute such contracts and agreements originally approved on May 10, 1984, pursuant to the terms of this ordinance. 4. That the City Secretary is hereby directed to file a copy of this Ordinance in the permanent records of her office. Alternative 1.
