AN ORDINANCE CONSENTING TO THE SALE OF CERTAIN REAL PROPERTY BY THE OLD
SETTLERS ASSOCIATION OF WILLIAMSON COUNTY.
WHEREAS, the Old Settlers Association of Williamson County, Texas as Seller
has by Earnest Money Contract dated April 1, 1985 and Amended June 29, 1985
agreed to sell certain Real Property being more fully described in EXHIBIT
"A", ("The Land") attached hereto and incorporated herein by reference for
all purposes, and
WHEREAS, "The Land" described in EXHIBIT "A" is part of a tract of land
conveyed by Maggie J. Harrell and husband, T.M. Harrell, to Ed R. Anderson,
president of the Old Settlers Association of Williamson County, Texas, which
deed is recorded in Volume 258, Page 276, of the Deed Records of Williamson
County, Texas, and
WHEREAS, in said deed from Maggie J. Harrell et vir recorded in Volume
258, Page 276, of the Deed Records of Williamson County, Texas, there was created
in the City of Round Rock, Texas a reversionary interest in the property thereby
conveyed, and
WHEREAS, the reversionary interest created in the City of Round Rock raises
some question as to the position of Buyer with regard to the premises, the
City of Round Rock and its reversionary rights, and
WHEREAS, the City of Round Rock has no desire to interfere with or impair
such sale but rather has a desire to cooperate with Old Settlers Association
of Williamson County, Texas, in carrying out their purposes, and
WHEREAS, the Old Settlers Association of Williamson County, Texas has
agreed to place similar reversionary interest provisions in any'.dee.dthey receive
pursuant to purchase of property with the funds of the herein described sale
or in any exchange of "The Land" for other real property pursuant to the Earnest
Money Contract described herein, NOW THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
I.
That the City of Round Rock Texas, does hereby agree that should the tract,
or any part thereof, conveyed by Maggie J. Harrell and husband, T.M. Harrell,
to Ed R. Anderson, president of the Old Settlers Association of Williamson
County, Texas, be sold, the City of Round Rock, Texas will take no action
pursuant to its right of reversion which would interfere with or impair such
sale.
II.
A. All ordinances, parts of ordinances, or resolutions in conflict herewith
are expressly repealed.
B. The invalidity of any section or provision of this ordinance shall
not invalidate other sections or provisions thereof.
