O-85-2162 - 3/14/1985ORDINANCE NO. 2162 AN ORDINANCE AMENDING CHAPTER 1, CODE OF ORDINANCES, CITY OF ROUND ROCK, BY ADDING SECTION 33, TO ESTABLISH A ROAD IMPROVEMENT FEE; DECLARING THE PURPOSE OF THE FEE; ESTABLISHING THE FEE AT THE SUM OF TWO HUNDRED DOLLARS ($200.00) PER LIVING UNIT EQUIVALENT OF NEW CONSTRUCTION; ESTABLISHING A SEPARATE ROAD IMPROVEMENT FUND; PROVIDING A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council finds that the acquisition, construction, and improvement of roads to serve new developments within the City of Round Rock is a major burden upon the City, and WHEREAS, the City and its extraterritorial jurisdiction is experiencing a rapid, large scale increase in intensity of land use and in population growth, and WHEREAS, the existing and projected funds of the City are not adequate to meet the projected road needs resulting from the growth, and WHEREAS, the failure to insure that road improvements are made as growth occurs and traffic increases, causes sever public safety problems, impedes commerce, wastes fuel and interferes with the comfort and repose of the public; WHEREAS, the Council deems it appropriate that the costs of providing new and improved roads should be borne, at least in part, by the new growth that causes the need, and WHEREAS, the provisions of this Ordinance are necessary to preserve the financial integrity of the City as well as to protect and preserve the public health, safety and general welfare, NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS I. That Chapter 1, Code of Ordinances, City of Round Rock is hereby amended by adding Section 33, which shall read as follows: Section 33. Road Improvement Fee: A. Purpose It is hereby declared to be the purpose of this Section to insure that public health, safety and welfare is preserved by requiring adequate roads to new and existing developments. To this end it is hereby declared to be the policy of the City of Round Rock to exert its authority over the regulation of development and construction, and to require payment for a proportionate share of the cost of road improvements due to such City approved land use developments. B.•Road Improvement Fee: (1) Each applicant for a permit for new construction inside the City limits shall at the time the permit is issued, pay a Road Improvement Fee of Two Hundred Dollars ($200.00) for each single family house or for each living unit equivalent to be constructed. (2) The number of living unit equivalents for non -single family detached residential use shall be determined as follows: (3) Type of Number of Residential Unit Living Unit Equivalents Duplex 0.9 Tri-plex, four-plex 0.7 and multi -family The number of living unit equivalents for commercial and industrial use shall be determined in accordance with the following formula: Building Area X 6 X Land Area = LUE's Land Area in Area C. Road Improvement Fund: All money generated by the Road Improvement Fee shall be deposited in a separate account and used only for the purpose of the construction and improvement of the City's road and street system. II. A. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. B. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. III. A.
