O-85-2147 - 1/24/1985ORDINANCE NO. 2147 AN ORDINANCE REPEALING ORDINANCE N0. 2143, ENACTED BY THE CITY COUNCIL ON DECEMBER 27, 1984, AND VACATING THE ALLEY IN BLOCK 6 OF THE ORIGINAL CITY OF ROUND ROCK, WILLIAMSON COUNTY, TEXAS. WHEREAS, the City Council of the City of Round Rock enacted Ordinance No. 2143, vacating a portion of the alley (the "Alley") in Block 6 of the original City of Round Rock, Williamson County, Texas, as shown on the map or plat thereof recorded in Cabinet A, Slide 34, Plat Records of Williamson County, Texas; WHEREAS, the City Council desires to clarify the property description to include the entirety of the Alley and to include within the description of the grantees or holders of reversionary interests in the land covered by the Alley all of the owners of adjacent lots in Block 6; WHEREAS, the City Council finds that no utilities presently exist in the Alley and that an easement in the Alley is not now, and will not be, needed for municipal use; and WHEREAS, the City Council finds that the Alley is not now, and will not be, needed for municipal use and is now surplus as to the City; Now, Therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK Section 1: That Ordinance No. 2143 is hereby repealed in its entirety. Section 2: That all of the Alley, located in Block 6 of the Original City of Round Rock, Williamson County, Texas, as shown by the map or plat thereof recorded in Cabinet A, Slide 34, Plat Records of Williamson County, Texas, be, and the same is hereby vacated and perpetually closed for public use; and that the fee to the land formerly covered by the Alley shall be granted or revert to the record owners of the lots adjacent to the alley in the said Block 6, as provided by law; and that the Mayor or other designated agent be hereby authorized to execute and deliver to the said record owners, upon request by each owner, an instrument in recordable form, including a quitclaim deed, evidencing such vacation and reversion. v i u Section 3: That no easements are hereby retained in the Alley; and that all easements for the benefit of the City, if any, through, under and across the Alley be, and the same are hereby vacated, abandoned and released.
