O-84-2134 - 9/27/1984ORDINANCE NO. 2134 AN ORDINANCE ABANDONING THE ALLEY WAY IN BLOCK 2, ORIGINAL PLAT OF THE CITY OF ROUND ROCK; RESERVING AN EASEMENT FOR PUBLIC UTILITIES; REPEALING ORDINANCE NO. 263. Whereas, on July 3, 1975, the City Council adopted Ordinance No. 263 which purported to abandon an alley way in Block 7 of the original plat of Round Rock, and Whereas, the written petition requesting said abandonment incorrectly described the alley way as being in Block 7, Original Plat, where in fact it should have said Block 2, Original Plat, Round Rock, and Whereas more than two thirds, 2/3 of the adjoining landowners to the alley way in Block 2, Original Plat of Round Rock have executed a petition requesting said alley way be abandoned, and Whereas, the said landowners have fully complied with the requirements of Ordinance No. 251, and Whereas, the property has been unused as an alley way for many years, and Whereas, the adjoining landowners have willingly consented to maintain said alley way if and when the same is abandoned, and Whereas, the City deems it advisable and finds it desirable to vacate and abandon said alley ways; Now Therefore BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS I. That the alley way in Block 2, Original Plat of the City of Round Rock be and the same is hereby closed, abandoned, and permanently vacated as an alley or public thoroughfare of any kind or character whatsoever. II. That the fee to the land in the above described alley way is released and will revert to the adjacent owners as provided by law, SAVE AND EXCEPT that an easement and right-of-way shall be reserved for the purpose of placing, constructing, operating, enlarging, repairing, maintaining, rebuilding, replacing, relocating and removing sewer lines, gas public utilities lines, electric lines, and any deemed necessary by the City, water lines, and all other together will all necessary conduits, valves, vaults, manholes, ventilation and appurtenances. Furthermore, the landowners shall not erect or construct any building or other structure, or drill or operate any well, or construct any reservoir or other obstruction on the alley way, or diminish or substantially add to the ground cover over the existing or future utilities. III. That Ordinance No. 263 is in all things repealed. (Mark through the following alternative that is not applicable) Alternative 1. By motion duly made, seconded and passed with an affirma- tive vote of all the Council members present, the requirement for reading this ordinance on two separate days was dispensed with. MIKE ROBINSON, Mayor City of Round Rock, Texas -2- PETITION to MAYOR and COUNCIL MEMBERS of the CITY of ROUND ROCK We, the undersigned landowners of Block 2, Original City of Round Rock, request that the City vacate and abandon the alley which traverses Block 2 and convey it to the adjacent landowners. We further request that each landowner be issued a Quit Claim Deed for the 10' wide strip of alley which runs adjacent to their property. We realize that we will be responsible for additional taxes for this property and that the gas company and the city wastewater department will retain the easements they require.
