O-84-2128 - 7/26/1984ORDINANCE NO. 2128 AN ORDINANCE AMENDING CHAPTER 10, SECTION 4.A.(6), AND CHAPTER 10, SECTION 4.B.(2), CODE OF ORDINANCES, CITY OF ROUND ROCK, TEXAS, TO INCREASE THE WATER AND WASTEWATER SERVICE FEES; PROVIDING FOR THE FEES TO BE PAID BY APPLICANTS FOR WATER AND SEWER SERVICE LOCATED OUTSIDE THE CITY LIMITS; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES. WHEREAS, the City of Round Rock, its Extraterritorial Jurisdiction and the area requested for certification of convenience and necessity for water and wastewater have experienced a rapid, large scale increase in population and intensity of land use, and WHEREAS, it is anticipated that the rapid growth will continue and even increase, and WHEREAS, this growth creates large demands for increased water and wastewater services, and WHEREAS, the existing and projected funds of the City are not adequate to meet the projected water and wastewater needs of the new growth, and WHEREAS, the Council has determined that new growth should bear a substantial portion of the direct costs associated with the provision of water and wastewater services to the new growth, and WHEREAS, it is deemed necessary to increase the water and sewer service fees to raise the necessary funds, and WHEREAS, the provisions of this ordinance are necessary to preserve the Council's goal for the financial integrity of the City, as well as to protect and preserve the public health, safety and general welfare, Now Therefore BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS I. That Chapter 10, Section 4.A.(6), Code of Ordinances, City of Round Rock, Texas, is hereby amended to read as follows: (6) Water Service, Inspection and Meter Setting, and Tap Fees (a) Water Service Fee (i) Each applicant for a permit for new construction inside the city limits shall at the time the permit is issued, pay a Water Service Fee of Six Hundred Fifty Dollars ($650.00) for each living unit equivalent to be served. (ii) The number of living unit equivalents for residential use shall be determined as follows: Type of Number of Residential Unit Living Unit Equivalents Single Family Detached 1.0 Duplex 0.9 per unit Tri-plex; four-plex and multi -family 0.7 per unit The number of living unit equivalents for commercial and industrial use shall be determined in accordance with the following formula: Building Area X 6 X Land Area = LUE's Land Area in acres (iii) All funds generated by this fee in excess of $150.00 per living unit equivalent shall be deposited in a separate account for Water and Wastewater Capital Improvements for the expansion and improvement of the City's Utility System. (b) Water Inspection and Meter Setting Fee (i) Each applicant for a plumbing permit, whether for new construction or otherwise, shall at the time the permit is issued pay a Water Inspection and Meter Setting fee of one hundred dollars ($100.00) for each water tap utilizing a standard size water meter. As used herein, "standard size water meter" means either a five-eighths inch (5/8") or a three-fourths inch (3/4") meter. In the event a water tap requires a nonstandard size water meter, the water inspection and meter setting fee shall be one hundred dollars ($100.00) plus the difference in actual cost of the water meter required and the actual cost of a standard size meter. (c) Water Tap Fee (i) In the event that the applicant for a plumbing permit shall desire the City to make the actual connection to the water main, then such applicant shall, at the time the plumbing permit is issued, pay a Water Tap Fee of two hundred dollars ($200.00) for each water tap made. The foregoing water tap fee is optional with the applicant, and shall not be required of any applicant who agrees to make the proper connection himself. 2 (d) Fees For Water Service Outside City Limits Applicants for water service outside the city limits shall pay the same water fees as set forth above. Applicants who are otherwise required by contract to obtain building permits shall pay the fees when a permit is issued. Other applicants shall pay the fees when water service is requested. II. That Chapter 10, Section 4.B.(2), Code of Ordinances, City of Round Rock, Texas, is hereby amended to read as follows: (2) Sewer Service, Inspection and Tap Fees (a) Sewer Service Fee (i) Each applicant for a permit for new construction inside the city limits shall at the time the permit is issued, pay a Sewer Service Fee of Six Hundred Fifty Dollars ($650.00) for each living unit equivalent to be served. (b) Sewer Inspection Fee Each applicant for a plumbing permit, whether for new construction or otherwise, shall, at the time the permit is issued, pay a sewer inspection fee of one hundred dollars ($100.00) for each sewer service connection to the main line. 3 (c) Sewer Tap Fee In the event that the applicant for a plumbing permit shall desire the City to make tha actual connection to the sewer main, then such applicant shall, at the time the permit is issued, pay a sewer tap fee of two hundred dollars ($200.00) for each sewer connection made. (d) Fees For Sewer Service Outside City Limits Applicants for sewer service outside the city limits shall pay the same sewer fees as set forth above. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B.
