ORDINANCE NO. 2097
AN -ORDINANCE AMENDING CHAPTER 7, CODE OF ORDINANCES,
CITY OF ROUND ROCK, TEXAS, BY DELETING REFERENCES TO
"PERMANENT", AND "TEMPORARY" PERSONNEL POSITIONS, AND
BY CLARIFYING CITY PERSONNEL POLICIES AS TO REGULAR AND
NON -REGULAR PERSONNEL POSITIONS.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
I.
That Chapter 7, Section 1.B.(6), Code of Ordinances, City of
Round Rock is hereby amended to read:
(6) Age Requirements
No person under eighteen (18) years of age shall be
appointed to any regular position. Otherwise, age
restrictions do not exist for any type of
employment, unless specifically stated in the job
qualifications. Any age limit specified for a
position is job-related.
II.
That Chapter 7, Section 1.B.(7), Code of Ordinances, City of
Round Rock, Texas is hereby amended to read:
(7) Types of Positions
All employees of the City will be designated as
either regular or non -regular at the time of
employment.
(a) Regular Positions
These are positions with a required work -week
equal to or exceeding the full time,
established work -week.
(b) Non -regular Positions
These are positions (part time or seasonal)
which will probably be of comparatively short
or definitely limited duration.
III.
That Chapter 7, Section 1.C.(3), Code of Ordinances, City of
Round Rock, Texas, is hereby amended to read:
(3) Probationary Periods
All persons appointed to regular positions in the
service of the City of Round Rock shall be required
to serve a probationary period of three (3)
continuous and consecutive months.
The purpose of such a probationary period is to
closely observe and evaluate the work of all newly
appointed employees and to encourage their
effective adjustment to the job and the service of
the City.
IV.
That Chapter 7, Section 1.C.(4), Code of Ordinances, City of
Round Rock, Texas, is hereby amended by adding subparagraph (f)
as follows:
(f) Performs or fails to perform in such a way as to
indicate that the employee may not, in the future,
meet the standards required by the City of Round
Rock.
V.
That Chapter 7, Section 1.C.(5), Code of Ordinances, City of
Round Rock, Texas, is hereby amended to read:
(5) Completion of Probationary Period
Upon the successful completion of the established
probationary period, such persons shall become
regular employees of the City of Round Rock, with
retroactive accumulation of vacation time and sick
leave. Ten (10) working days prior to the
completion of the probationary period, a written
report of the employee's success on the job will be
completed by the immediate supervisor. The report
will be forwarded to the Department Head who will
make a decision to retain or terminate the
employee. The report with the Department Head's
decision will be sent to the Finance Department and
placed in the employee's personnel file.
VI.
That Chapter 7, Section 1.F.(2), (3), and (4), Code of
Ordinances, City of Round Rock, Texas, are hereby amended to
read:
(2) Eligibility for Leaves of Absence
Only regular employees may receive vacation, sick
leave, or retirement benefits.
(3) Annual Vacation Leave
Vacations will be computed on "anniversary dates",
that is the date on which an employee began working
for the City.
Regular employees initially accumulate vacation
time at the rate of one (1) day per calendar month,
not to exceed twelve (12) working days. On or after
the first anniversary of service, the employee is
eligible to use his accumulated vacation time.
Employees who terminate their employment in good
standing, after twelve (12) or more consecutive
months of employment by the City of Round Rock,
will be paid for any accumulated vacation time.
Employees who are dismissed from service for any of
the causes listed in Subsection I will not receive
pay for any accumulated vacation time.
Vacation time may be accumulated for more than one
(1) year and it is expressly provided that upon
voluntary termination, no employee may be paid for
accumulated leave in excess of twenty-four (24)
days.
When a regular employee commences his/her third
(3rd) year of consecutive service, he/she begins
accumulating vacation leave at the rate of one and
one-fourth (1 1/4) days per calendar month. When a
regular employee commences his tenth (10th) year of
consecutive service, he/she begins accumulating
vacation leave at the rate of one and one-half (1
1/2) days per calendar month.
Before vacation time is taken, written notice of
intent must be submitted to the City Manager and
verification made of accumulated time. Vacation
schedules will be established by the Department
Head with priority being given on the basis of
seniority.
(4) Sick Leave
An employee who is ill and cannot report for work
should call his or her supervisor immediately
before working hours, to give the supervisor time
to make other arrangements. A regular employee may
accumulate one (1) day sick leave for each
consecutive month of service up to thirty (30)
days. In case of serious illness, an employee may
use all of his or her accumulated sick leave, plus
any accumulated vacation time. Use of sick leave in
lieu of vacation time will be grounds for
dismissal.
The City may require the employee to submit a
doctor's certificate when an employee requests sick
leave pay, regardless of the length of illness.
Employees will not be paid for any accumulated sick
leave when their employment is terminated.
Employees will not be compensated for sick leave
during the first ninety (90) days of employment.
VII.
That Chapter 7, Section 1.F.(7), Code of Ordinances, City of
Round Rock, Texas, is hereby amended to read:
(7) Maternity Leave
Maternity leave without pay may be granted regular
employees for a period of not to exceed sixty (60)
calendar days upon the approval of the Department
Head. Continued employment during pregnancy will be
contingent upon an employee's health, safety, and
ability to satisfactorily perform her duties. A
written statement must be furnished by a physician
setting forth the date on which the employee will
discontinue her work for the City. Prior to taking
maternity leave, the employee must meet with the
Department Head and obtain agreement on the length
of time she will be absent. At the time a regular
employee requests maternity leave, a written
request for reinstatement must also be filed with
the Department Head if the employee wishes to
return to the job after her maternity leave
expires.
Accrued sick leave and vacation benefits may be
used by employees on maternity leave to cover the
time off. If the employee returns to work, the
employee retains all benefits accumulated before
taking maternity leave. No benefits will be accrued
while an employee is on maternity leave. A medical
clearance is required to return to work.
VIII.
That Chapter 7, Section 1.I.(2), Code of Ordinances, City of
Round Rock, Texas, is hereby amended to read:
(2) Examples of Grounds for Disciplinary Action and/or
Dismissal
An employee may be subject to disciplinary action
or dismissal for reasons including but not limited
to the following:
(a) Incompetence or inefficiency
(b) Conduct unbecoming an employee of the City
(c) Physical or mental ailments that interfere with
proper job performance
(d) Insubordination or any violation of any
official order or regulation
(e) Accepting bribes related to the course of work
(f) Failure to pay just debts
(g) Conviction of a felony
(h) Negligent or willful damage or waste of public
property
(i) Engaging in illegal political activities
(j) Any activity not compatible with good public
service
(k) Habitual tardiness, absenteeism or absence
without proper leave
(1) Failure to meet an acceptable standard of work
IX.
That Chapter 7, Section 1.J.(1), Code of Ordinances, City of
Round Rock, Texas, is hereby amended to read:
(1) Texas Municipal Retirement System
All regular, City Employees who are eligible shall
participate in the Texas Municipal Retirement
System. The City of Round Rock contributes jointly
with employees to the Texas Municipal Retirement
System.
