O-84-2091 - 1/26/1984ORDINANCE NO. 2091 AN ORDINANCE AUTHORIZING THE CITY ATTORNEY, OR OTHER ATTORNEY OR ATTORNEYS RETAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, TO ACQUIRE CERTAIN REAL PROPERTY OWNED BY GEORGE CLARK FOR USE AS A PUBLIC PARK. WHEREAS, the City Council deems it necessary for the public good and welfare to take necessary steps to preserve and protect the "round rock," the City's namesake, located near the Chisholm Trail low water crossing of Brushy Creek, and WHEREAS, certain real property in the vicinity of the "round rock", is suitable for use as a public park, and WHEREAS, the Council of the City of Round Rock, Texas, has determined that real property should be acquired and set aside for use as a public park, and WHEREAS, the citizens of the City have authorized the issuance of bonds to finance the acquisition, preservation, and development of the area as a public park, and WHEREAS, one of the tracts suitable and necessary for the construction and establishment of a public park is described in Exhibit "A" attached hereto, and WHEREAS, negotiations with the owner or owners of the above-described tract to purchase said tract have not been successful, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS That the City Attorney or other attorneys retained by the Council of the City of Round Rock, Texas, are hereby authorized to proceed immediately with the acquisition by eminent domain of the above described property for use by the City of Round Rock, Texas, as a public park. (Mark through the following alternative that is not applicable) Alternative 1. By motion duly made, seconded and passed with an affirma- tive vote of all the Council members present, the requirement for reading this ordinance on two separate days was dispensed with. Harrell Survey, Abstract No. 284, situated in the City of Round Rock, Williamson County, Texas, being a portion of that certain tract of land conveyed to George Clark and wife, Caroline Clark, by deed dated March 21, 1921, recorded in Volume 201, Page 568, of the Deed Records of said County, being more particularly descirbed by metes and bounds as follows: BEGINNING FOR REFERENCE at a point in the centerline of Brushy Creek, being in the East right-of-way line of Chisholm Trail Road, also being the Southwest cor- ner of that certain 4.96 acres conveyed to E. L. Scott by deed recorded in Vol- ume 537, Page 335 of said Deed Records, and the Northwest corner of a 5.677 acre tract conveyed to Edward D. Quick by deed recorded in Volume 599, Page 64 of said Deed Records, said point also being the approximate centerline of "The Round Rock", a Texas state historical marker; thence S82°17'30"W, 46.89 feet to a point in said creek centerline, also being in the West right-of-way line of Chisholm Trail, being the Northeast corner and POINT OF BEGINNING of the herein- after described 0.654 acre; THENCE along said West right-of-way line the following four (4) courses: 1) S06°05'E, 55.80 feet to an iron pin set, being an angle point hereof; 2) SO0°46'W, 41.40 feet to an iron pin set, being an angle point hereof; 3) SO1°09'E, 53.40 feet to an iron pin set, being an angle point hereof; 4) SO4°23'E, 9.95 feet to an iron pin set in the 708.5 foot contour line, being the Southeast corner hereof; THENCE departing said West right-of-way line, in a Westerly direction, along said 708.5 foot contour line, S80°10'30"W, 151.14 feet to an iron pin set in the East right-of-way line of that certain Missouri Pacific Railroad Company right- of-way, being the Southwest corner hereof; THENCE along said East right-of-way line, being the West line hereof, N18°27'30"W, 168.24 feet to a point in said creek centerline, being the North- west corner hereof; THENCE along said creek centerline, being the North line hereof, N82°17'30"E, 196.78 feet to the POINT OF BEGINNING of the herein described tract of land con- taining 0.654 acre or 28,488 square feet of land more or less.
