AN ORDINANCE AUTHORIZING THE CITY ATTORNEY, OR
OTHER ATTORNEY OR ATTORNEYS RETAINED BY THE COUNCIL
OF THE CITY OF ROUND ROCK, TEXAS, TO ACQUIRE
CERTAIN REAL PROPERTY OWNED BY A PERSON OR PERSONS
UNKNOWN TO THE CITY OF ROUND ROCK FOR USE AS A
PUBLIC PARK.
WHEREAS, the City Council deems it necessary for the
public good and welfare to take necessary steps to preserve
and protect the "round rock," the City's namesake, located
near the Chisholm Trail low water crossing of Brushy Creek,
and
WHEREAS, certain real property in the vicinity of the
"round rock", is suitable for use as a public park, and
WHEREAS, the Council of the City of Round Rock, Texas,
has determined that real property should be acquired and set
aside for use as a public park, and
WHEREAS, the citizens of the City have authorized the
issuance of bonds to finance the acquisition, preservation,
and development of the area as a public park, and
WHEREAS, one of the tracts suitable and necessary for
the construction and establishment of a public park is
described in Exhibit "A" attached hereto, and
WHEREAS, the City of Round Rock has been unable to
conduct negotiations with the owner or owners of the
above-described tract to purchase said tract for the reason
that the owner or owners, if any, are unknown to the City of
Round Rock, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS
That the City Attorney or other attorneys retained by
the Council of the City of Round Rock, Texas, are hereby
authorized to proceed immediately with the acquisition by
eminent domain of the above described property for use by the
City of Round Rock, Texas, as a public park.

County, Texas, being all of that land bounded on the West by the Missouri Paci-
fic Railroad Company right-of-way, on the North by that certain land conveyed to
J. B. Rutland and wife, Harriet Irvin Rutland by deed recorded in Volume 501,
Page 387 of the Deed Records of said County, on the East by Chisholm Trail Road,
and on the South by Brushy Creek, being more particularly described by metes and

BEGINNING at an iron pin found in the West margin of said Chisholm Trail Road,
being the Southeast corner of said Rutland tract, being the Northeast corner
hereof;

line hereof, S03°221E, 197.09 feet to a point in the centerline of said Brushy
Creek, being the Southeast corner hereof;
THENCE along the centerline of said Brushy Creek, being the South line hereof,
S82°17'30"W, 176.61 feet to a point in the East right-of-way line of said rail-
road, a twenty (20) foot wide right-of-way, being the Southwest corner hereof;
THENCE along said East right-of-way line, being the West line hereof,
N18°27'30"W, 189.64 feet to an iron pin set, being the Northwest corner hereof;
THENCE departing said railroad right-of-way line, in an Easterly direction,
being the extended South line of said Rutland tract, being the North line here-
of, N79°43'E, 22.53 feet pass an iron pin set at the Southwest corner of said
Rutland tract, and continue a distance of 204.60 feet, in all being a total dis-
tance of 227.13 feet to the POINT OF BEGINNING of the herein described tract of
land containing 0.888 acre or 38,672 square feet of land more or less.
