O-83-2086 - 12/22/1983ORDINANCE NO. 2086 AN ORDINANCE AUTHORIZING THE CITY ATTORNEY, OR OTHER ATTORNEY OR ATTORNEYS RETAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, TO ACQUIRE CERTAIN REAL PROPERTY OWNED BY A PERSON OR PERSONS UNKNOWN TO THE CITY OF ROUND ROCK FOR USE AS A PUBLIC PARK. WHEREAS, the City Council deems it necessary for the public good and welfare to take necessary steps to preserve and protect the "round rock," the City's namesake, located near the Chisholm Trail low water crossing of Brushy Creek, and WHEREAS, certain real property in the vicinity of the "round rock", is suitable for use as a public park, and WHEREAS, the Council of the City of Round Rock, Texas, has determined that real property should be acquired and set aside for use as a public park, and WHEREAS, the citizens of the City have authorized the issuance of bonds to finance the acquisition, preservation, and development of the area as a public park, and WHEREAS, one of the tracts suitable and necessary for the construction and establishment of a public park is described in Exhibit "A" attached hereto, and WHEREAS, the City of Round Rock has been unable to conduct negotiations with the owner or owners of the above-described tract to purchase said tract for the reason that the owner or owners, if any, are unknown to the City of Round Rock, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS That the City Attorney or other attorneys retained by the Council of the City of Round Rock, Texas, are hereby authorized to proceed immediately with the acquisition by eminent domain of the above described property for use by the City of Round Rock, Texas, as a public park. (Mark through the following alternative that is not applicable) Alternative 1. By motion duly made, seconded and passed with an affirmative vote of all the Council members present, the requirement for reading this ordinance on two separate days was dispensed with.
