AN ORDINANCE AUTHORIZING THE CITY ATTORNEY, OR
OTHER ATTORNEY OR ATTORNEYS RETAINED BY THE COUNCIL
OF THE CITY OF ROUND ROCK, TEXAS, TO ACQUIRE
CERTAIN REAL PROPERTY OWNED BY HARRIET RUTLAND FOR
USE AS A PUBLIC PARK.
WHEREAS, the City Council deems it necessary for the
public good and welfare to take necessary steps to preserve
and protect the "round rock," the City's namesake, located
near the Chisholm Trail low water crossing of Brushy Creek,
and
WHEREAS, certain real property in the vicinity of the
"round rock", is suitable for use as a public park, and
WHEREAS, the Council of the City of Round Rock, Texas,
has determined that real property should be acquired and set
aside for use as a public park, and
WHEREAS, the citizens of the City have authorized the
issuance of bonds to finance the acquisition, preservation,
and development of the area as a public park, and
WHEREAS, one of the tracts suitable and necessary for
the construction and establishment of a public park is
described in Exhibit "A" attached hereto, and
WHEREAS, negotiations with the owner or owners of the
above-described tract to purchase said tract have not been
successful, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS
That the City Attorney or other attorneys retained by
the Council of the City of Round Rock, Texas, are hereby
authorized to proceed immediately with the acquisition by
eminent domain of the above described property for use by the
City of Round Rock, Texas, as a public park.

tive vote of all the Council members present, the requirement
for reading this ordinance on two separate days was dispensed
with.

FIELD NOTES FOR 0.264 ACRE
FIELD NOTES describing a 0.264 acre tract or parcel of land out of the J. M.
Harrell Survey, Abstract No. 284, situated in the City of Round Rock, Williamson
County, Texas, being a portion of that 1.29 acres conveyed to J. B. Rutland and
wife, Harriet Irvin Rutland by deed recorded in Volume 501, Page 387 of the Deed
Records of said County, being more particularly described by metes and bounds as
follows:
BEGINNING at an iron pin found in the West margin of Chisholm Trail Road, being
the Southeast corner of said 1.29 acres, being the Southeast corner hereof;
THENCF along the South line of said 1.?9 acres. being the South line hereof.
S/9"4.3'W, 204.60 teet to an iron pin set, beiny the Southwest currier of said
1.29 acres, being the Southwest corner hereof;
THENCE along the West line of said 1.29 acres, being the West line hereof,
N20°30°W, 72.35 feet to an iron pin set in the 708.5 foot contour line, being
the Northwest corner hereof;
THENCE along said 708.5 foot contour line, being the North line hereof, the fol-
lowing three (3) courses:
1) S71°37'E, 71.60 feet to an iron pin set, being an angle point hereof;
2) N63°471E, 110.72 feet to an iron pin set, being an angle point hereof;
3) S82°45 E, 56.87 feet to an iron pin set in said West margin, being the
Northeast corner hereof;
THENCE along said West margin, being the East line of said 1.29 acres, being the
East line hereof, S03°22'E, 50.50 feet to the POINT OF BEGINNING of the herein
described tract of land containing 0.264 acre or 11,510 square feet of land more
or less.
I, Steven D. Kallman, a REGISTERED PUBLIC SURVEYOR, do hereby certify that these
field notes and attached plat accurately represent the results of an on -the -
ground survey made under my direction and supervision on the 25th day of August,
1983. A11 corners located are as shown. There are no encroachments, conflicts
or protrusions apparent on the ground except as shown.
