RESOLUTION NO. R -07-01-25-9B2 WHEREAS, the City of Round Rock has previously entered into a contract ("Contract") with Keystone Construction, Inc. for the Raw Water Delivery System - Pumps Improvements Project, and WHEREAS, the Council has determined that it is necessary to make changes to the quantity of work to be performed or materials, equipment, or supplies to be provided, and WHEREAS, it has been determined that it is necessary to change said Contract in accordance with the attached Contract Change Order No. 1, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City Contract Change Order No. 1 to the Contract with Keystone Construction, Inc. for the Raw Water Delivery System - Pumps Improvements Project, a copy of said change order being attached hereto as Exhibit "A" and incorporated herein for all purposes. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Consider a resolution authorizing the Mayor to execute Change Order No. 1 to the construction contract with Keystone Construction, Inc. for the Raw Water Delivery System - Pumps Improvement Project. Department: Water and Wastewater Utilities Staff Person: Michael Thane, Utility Director Justification: With approval of the construction contract with Keystone Construction, Inc. for $4,218,317.14 to increase the raw water delivery capacity from Lake Georgetown from 39 million gallons per day (mgd) to 48 mgd, Change Order No. 1 would increase the capacity to 52 mgd, which is the City's total capacity in Lake Stillhouse and Lake Georgetown. This Change Order is in the amount of $871,967.18 or 20.67% of the original contract amount. Approval of the change order will give the City an additional 4 mgd of raw water capacity for about 22 cents per gallon. Therefore, staff agrees with the Design Engineer's recommendation to approve Change Order No. 1. Funding: Cost: $871,967.18 Source of funds: Capital Project Funds (Self -Financed Utility) Outside Resources: Keystone Construction, Inc. Camp Dresser &McKee (CDM) Background Information: The City Water Treatment Plant (WTP) was expanded to a capacity of 48 mgd with the completion of the Phase V plant expansion. The City is in the process of getting approval from TCEQ to re -rate the WTP to 52 mgd. Therefore, because of the re -rating of the plant, the City asked the Design Engineering, (CDM), to negotiate with Keystone the cost to the City to increase the capacity to 52 mgd. The result of these negotiations is the reasonable cost of Change Order No. 1. A subsequent project for the Raw Water Delivery System - Line Improvements is under design to construct about 20,000 linear feet of 54 -inch raw water line that will be bid in the Spring of 2007 provided we have acquired all the required easements. This would complete the improvements required to deliver 52 mgd of raw water to the WTP from Lake Georgetown and Lake Stillhouse.
