O-92-2601 - 11/12/1992ORDINANCE NO. 2601 AN ORDINANCE AMENDING CHAPTER 6, SECTION 6.607, (1), CODE OF ORDINANCES (1990 EDITION), CITY OF ROUND ROCK BY PROVIDING FOR A FRANCHISE FOR THE COLLECTION OF REFUSE FROM COMMERCIAL ESTABLISHMENTS; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 6, Section 6.607(1), Code of Ordinances (1990 Edition), City of Round Rock is hereby amended to read as follows: 6.607 COLLECTION RESTRICTED (1) Franchise Required It shall be unlawful for any person to engage in the business of collecting refuse from commercial establishments within the City of Round Rock unless he shall have been issued a franchise therefore which is in force and effect. The franchise fee shall be ten percent (10%) of gross revenues and payable quarterly. II. That this Ordinance shall be effective on January 1, 1993. III. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. OR10202E Alternative 1. DATE: November 10, 1992 SUBJECT: City Council Meeting, November 12, 1992 ITEM: 11C. Consider an ordinance requiring franchises for commercial garbage service providers. (Second Reading) STAFF RESOURCE PERSON: Jim Nuse STAFF RECOMMENDATION: Funding street repair and maintenance is a growing issue. Garbage trucks cause a great deal of wear and tear on the streets. Currently the residential refuse collector, Round Rock Refuse, pays a fee which covers use of City streets. The commercial haulers currently pay only a minimal fee in Round Rock. A fee is charged in all other cities surveyed. Representatives of the haulers and City staff are meeting to agree on an appropriate fee. Further details will be presented at the meeting.
