O-83-998 - 4/14/1983ORDINANCE NO. aqi AN ORDINANCE SETTING A DATE AND TIME FOR A PUBLIC HEARING TO BE HELD ON THE SITE OF THE PROPOSED ANNEXATION AND SETTING A DATE, TIME, AND PLACE FOR A PUBLIC HEARING ON THE PROPOSED ANNEXATION OF CERTAIN PROPERTY BY THE CITY OF ROUND ROCK, TEXAS, AUTHORIZING AND DIRECTING THE CITY SECRETARY TO PUBLISH NOTICE OF SUCH PUBLIC HEARINGS. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT I. On the 12th day of May , 19 83 , at 6:00 o'clock p .m. on the site of the property proposed to be annexed, the City Council will hold a public hearing giving. all interested persons the right to appear and be heard on the proposed annexation by the City of Round Rock, Texas, of the property described in Exhibit "A" attached hereto and made a part hereof. II. On the 12th day of May , 19 83 , at 7.0n o'clock p .m. in the City Council Chambers of the City of Round Rock, Texas, the City Council will hold a public hearing giving all interested persons the right to appear and be heard on the proposed annexation by the City of the above-described property. The City Secretary is hereby authorized and directed to cause notices of such public hearings to be published in a newspaper having general circulation in the City and in the territory proposed to be annexed; such notices to be pub- lished at least once, in such newspaper not more than twenty .(20) days nor less than ten (10) days prior to said hearings, all 'in accordance with the Municipal Annexation Act. IV. The Director of Planning is hereby authorized and directed to prepare a service plan that provides for the extension of municipal services into the area proposed to be annexed. (Mark through the following alternative that is not appli- cable) Alternative 1. By motion duly made, seconded and passed with an affirma- tive vote of all the Council members present, the requirement for reading this ordinance on two separate days was dispensed with. TOOVN , Mayor City of Round Rock, Texas EXHIBIT "A" Field Notes describing a certain 8.795 acre tract or parcel of land, and an easement later described as Parcel Two, out of the David Curry Survey, Abstract No. 130 situated in Williamson County, Texas, said tract being all of that tract conveyed by Robert W. Phillip et ex to Vosco, Inc. described in a deed recorded in Volume 661, Page 340 at the Deed records of Williamson County, Texas, and is more fully described by metes and bounds as follows: Parcel One Beginning at an iron pin found at the Southwest corner of said Vosco, Inc. tract, the Southwest corner hereof, and also being in the North R.O.W. line of County Road No. 125, also known as Bowman Road, said. corner also being the Southeast corner of a four acre tract described in a Deed of Trust to N. G. Whitlow, Trustee, recorded in Volume 186, Page 678 of said Deed Records; Thence N.17°45'W. 1321.89 feet along the West line of said Vosco tract and the East line of said four acre tract to an iron pin found at the Northwest corner and Northeast corner, respectively, of said tracts, and the Northwest corner hereof, said point being under a fence, the occupied North line of said Vosco tract and the most Westerly South line of a 23.81 acre tract conveyed to Homes by Bill Kitts, Inc., described in a deed recorded in Volume 660, Page 841 of said Deed Records; Thence N.74°20'E. 290.03 feet along said fence to an iron pin found at the Northeast corner of said Vosco tract, the Northeast corner hereof; Thence S.17°56'30"E. 1302.14 feet along the East line of said Vosco tract to an iron pin found at the Southeast corner of said tract, the Southeast corner hereof, being in the aforesaid North R.O.W. line; Thence S.70°27'20"W. 294.34 feet along said R.O.W. line to the Point of Beginning of this herein described tract containing 8.795 acres of land more or less. Parcel Two Being a fifty (50) foot wide easement for street purposes and constructing and maintainingpublic utilities together with the right to dedicate the same to public use, said easement lying within a strip of land fifty (50) feet Easterly of and adjacent to the West line of the above described- Parcel One. Haynie, A REGISTERED PROFESSIONAL ENGINEER, do hereby certify that these field notes and attached plat accurately represents the results of an on the ground survey made under my direction and supervision on the 25th day of March, 1977.
